I-765 now requires that we send a copy of our passport?

Hi Everyone,

I'm filling out my renewal forms, and I came across this when completing the I-765 (it's listed in the instructions document):

3. You must submit the following documents.

A. A copy of at least one of the following documents: Form I-94, Arrival-Departure Record (front and back), a printout of your electronic Form I-94 from www.cbp.gov/i94, passport, or other travel document. If you are filing Form I-765 under the (c)(9) category, copies of any of the above are not required.

B. A copy of your last EAD (front and back).

C. Photographs

I have never submitted a copy of my passport for a renewal app before. I have a passport, so it's not a problem. But this is actually a change from the normal application package in my experience. Is everyone now submitting copies of their passport?

We are c22 so we don’t need that. Just an ID or EAD is fine

No, we are not required to send that.

and/or fingerprint. The identity document photocopy must clearly show your facial features and contain your biographical information.
NOTE: If you are filing under the (c)(33) category, you are not required to submit additional documentation beyond what you submit with Form I-821D under 2. What documents do you need to provide to prove identity in the Evidence for Initial Requests Only section of the Form I-821D Instructions.

I-821D under 2

Submit copies of any of the following:
A. Passport;
B. Birth certificate accompanied by photo identification;
C. Any national identity document from your country of origin bearing your photo and/or fingerprint;
D. Any U.S. government immigration or other document bearing your name and photograph (e.g., EADs, visas, driver’s licenses, non-driver cards);
E. Any school-issued form of identification with photo;
F. Military identification document with photo;
G. State-issued photo ID showing date of birth; or
H. Any other document with photo that you believe is relevant.
NOTE: Expired documents are acceptable.
So, based on the above... a front/back copy of EAD and driver's license should suffice.

What confuses me is that what you highlighted is under item B which refers to the EAD. The passport requirement is under item A. Therefore, is it a different requirement? Can the exception for item B apply to item A?

I sent a copy of my I-94. The instructions made it seem that was required.

What do you use for you initially application? Whatever you used you should use again

Also had the SAME question.

EAD form seems to have gotten a bit longer than last time...

I overstayed my visa --> Undocumented so I DO have a copy of my expired visa/I-94.
Should I send that in? Or leave that section blank?
I dont see that it's absolutely necessary since I already have DACA 821 c33

someone please advise. Thank you
