My MIL insists my husband doesn’t have to leave the US to start adjusting status...

Long story, short: My husband who has DACA and EWI is waiting for his 601A waiver to be approved. The NVC already approved the documents we uploaded, so he’s just waiting for that to go to the embassy in El Salvador. Well, my MIL insists he doesn’t have to leave the country at all and that he doesn’t even need a waiver to go. We’ve explained to her that if you’re EWI, this is how the process is. Every time he talks on the phone with her, she always brings it up. Recently, she said people at her church have told her they got their green card without leaving at all. My husband told her that she doesn’t know the whole story behind those people and maybe they overstayed their visa or had AP. She says they’re not lying because of their faith...How can we make it more clear to her?

She is wrong, move along.

However, there is one exception for EWI, if your spouse is in the military, you can do your interview in the U.S.

She is ignorant of the laws. I hate when people are always like well so and so didn’t have to do that and blah blah. How do you know? People lie and omit or they have different cases and circumstances. I would just ignore her.

Follow the procedure that USCIS has not what anyone says.

Did your husband ever get AP with DACA? Many cleared their EWI with AP and adjusted here if immediate relative like spouse.

No, he wasn’t able to get AP. We found out about that too late. :/

No matter what she says if he's EWI he has to go. Honestly it is nerve wracking having to leave the country to go to the interview, but in my experience it was the easiest, less stressful part of the whole process

That used to be true, if you were petitioned prior to April 30th 2001 and got in under 245(i), and a lot of people did. That is no longer the case, so unless she was petitioned and he was under 21 at the time she should kindly shut the fuck up.

Also, you can't really argue with stupid people. If you can't convince her then ignore her and give her one word answers like no or okay if she keeps trying to drive her point across. You can also put the blame on her "Well, if you were to do things right and get a tourist visa he could get his green card without leaving, but you had to fuck everything up.

I got it now, tell that lady that it's her fault the situation you find yourself in. It's her fault for breaking the law without regard to the consequences. That will shut her up. It's unbelievable.
