Cosular Interview in Nov employment based visa + 601A

I-140 approved in 2019
601A approved in 2021
I was waiting on consular interview which i finally got now and is scheduled for end of November.
I am, naturally, feeling nervous and wondering what kind of questions they will ask.
I have already filed AP about 2 months ago, but asked for a date after Dec 2021 as I didnt think it can get processed in less than 4-6 months. It is looking like I will have to depart US for my consular interview without the AP backup/plan B on my side. Hopefully I will not need it but it would have been nice to have that extra help. I understand the AP has to be approved before you depart, it is not like I can leave and God forbids my visa does get not approved, wait for my AP there.

Any suggestions for my interview or examples of questions being asked for employment based ? Thank you!

If you are not in a hurry, you can ask to reschedule your consular interview to line up with your AP.

Congrats on everything so far! I'm also going through the same process, i-140/i-601a. Just submitted the i-601a petition a couple months ago.

Unfortunately I don't have much advice to give as I'm also hoping to apply for AP as well. I'm almost wondering what's the right time to apply for AP. Could you have done it earlier? Or did you have to wait for the i-601a waiver to get approved before you applied for AP?

Do you have an attorney that is filing these forms for you? I'm assuming they can tell you what questions to expect. My attorney has told me that they will help me through the process and they have been very helpful in answering my questions.

I could have, and should have, applied earlier. But my lawyer had given me inaccurate information as to when things happen, like for example, after my 601A he was sitting waiting on doing my ds-260 saying that it take up to a year for NVC to let us do that. Luckily through info here and other forum I figured out that was wrong and filed it.
It has been a matter of misinformation and confusion and processing times in the US embassy abroad. There is no visibility to that as there is for USCIS and NVC processing times. That is why I couldn't really time the AP to work with me.
I filed the AP myself as most people do, as it is not a long form. And because my process is employment based, I HAVE to use the companies lawyers with really dont have experience with 601A and have given me the wrong info. I have consulted lawyers outside too but the most accurate info I have gotten here and on facebooks groups.
I think your attorney sounds like a good one.

Yeah, I am kind of in need to get it this done ASAP, besides of course the 20 years waiting for an opportunity like this. But you are right that that is an option.

I also had to use my company's lawyer for the i-140. But for the i-601a part, I ended up not doing it with the company lawyer, as they were also telling me obviously wrong things about it to me as well. Maybe also because they mostly do employment stuff and not waivers. So I ended up doing the waiver part with an outside lawyer that I've known for a while and trusted. My company let me do that after I asked, but I had to pay out of my own pocket.

But maybe your lawyer could help at least in preparing you for any employment related questions you might encounter at the interview.

I wish I knew more about the consular interview so that I could help you. I keep checking the Official I-601A Thread in the Lounge to see what kind of questions have been asked in the consular interview. I think it seems helpful even though most people there do it through an i-130. But I suspect some questions would be similar.

I did my consular interview in august but yeah mine was marriage based so I did i130. I didn’t need a waiver since I’ve had daca since I was 17(did not accrue unlawful presence).
First the questions were the typical marriage questions
Then he asked me how I entered in this country (answered EWI in El Paso when I was 4 years old)
Asked me who I crossed with , if I ever travelled to any other countries or if I ever left USA since
Then asked me to see all my daca approval letters and he made sure I didn’t lapse and also did the math to make sure I had it before turning 18
Also asked about my parents status. I believe that is it

Thank you. I supposed they asked for all the DACA approvals to prove you didnt have any lapse as you said. Since, I obviously did and that is why I had to get the 601A. They probably wont be asking me for it. but will take the approvals I have, I dont think I have all of them though.

did your employer file H1Bs/Labor certification prior to filing I-140 for you?

Yes, they did file labor certification (no H1B) with the DOL . I think that took about 5-6 months to get processed.
