Can a person who was deported and returned EWI (shortly after) with an active DACA apply for AP and if granted, have no issues upon return?

if AP is the only way to adjust papers for that person then I would say take a risk. other than that dont risk it. might become an issue. also, if its easy for that person to enter again after another deportation then I would take that risk. but remember later these deportation might become a problem.

however, if travel in unnecessary then avoid it.

how can someone be deported and still have active DACA? if person was deported and returned shortly after then I'm assuming their DACA was no longer active. DACA protects you against deportation

i summarized to make it short. maybe too short.

deportation happened as a kid, long before daca. apparently, we got fake visas and didn't know it. sadly.

fast forward to daca, got granted. got a house, car, good job, etc.
seeing a lot of people take advantage of AP but i'm hesitant to try due to the deportation way back then.
they/computers don't forget, so i was wondering if AP gets granted if i'd be ok coming back or if customs will deny entry based on that record.

Wouldn't try it, if you were ordered report and re-EWI'd then ICE is completely within their rights to reinstate that order.

Ohh I get it now. Yeah that is risky, honestly i've tried to be very well informed when it comes to DACA but I have not heard about someone with a similar case before. I mean you got DACA, government has approved your stay, and has deferred your case from deportation, that is a good indicator that you may not have any issues. If you got fake visas, you must have done that when you were a kid, the government will most likely fail prosecuting or deporting you for that because you were a kid and did not know. Honestly, if you are thinking on using AP to adjust your status, now is the best time to do it though, at your own risk (like we have all done it). We never know what the next government will be like, if you remember what it was like under Trump Administration.

submit a FOIA request and see if it's still there. i went through a similar situation and when the FOIA came out it wasnt even there anymore.

after getting your FOIA head to an immigration lawyer and work it out.
