WASHINGTON – A U.S. judge in Texas on Thursday ruled against President Joe Biden’s program offering a path to citizenship for certain immigrant spouses of U.S. citizens, a blow that could keep the program blocked through Biden’s final months in office.

U.S. District Judge J. Campbell Barker found the program, which offers a path to citizenship to around 500,000 immigrants who entered the U.S. illegally if they are married to U.S. citizens, exceeded Biden’s executive authority.

The initiative, known as Keeping Families Together, launched in August but was blocked days later by Barker, who left it frozen while he considered a legal challenge brought by Texas and a coalition of U.S. states with Republican attorneys general.

Question:
So if you're undocumented and you marry a U.S. citizen, it does not grant you a path to legal status??

It's basically back to status quo. Gist of it being that if you EWI'd you'll likely need an I-601A. If you overstayed, used AP, or had a Quilantan entry then you will remain eligible to adjust.

Of course it all depends. There are ways to adjust after an EWI (e.g. VAWA or COR), there's also ways to get banned for life after an overstay (claim to be a US citizen in any context).

It is truly disheartening to admit that the Parole Place in program was doomed from the start. The Biden/Harris administration's insincerity in addressing our concerns was painfully obvious. Their attempt to gain Latino votes through this last-minute scheme was destined to fail and they knew it.

The administration's presentation of an "immigration for all" bill in Congress was nothing but a cruel joke. They knew it was a futile effort, yet they chose to toy with our hopes.

The betrayal by the administration has cost them the trust and support of the Latino community. It is heartbreaking to see them disregard our concerns and mock our struggles.

Right when we need the Democrats to win the most and the biggest they let us down. One day, when I finally die I want all my pallbearers to be Democrat elites so they can let me down one last time.
