BREAKING NEWS: California Supreme Court to review AB540!

Just one hour ago during a conference meeting, California Supreme Court decided to review AB540!!!!!!!!!!!!!!!!!!!!!!!!!

I just got a text from a buddy of mine working in California Supreme Court. My source is very very reliable.

Two implications:
1. AB540 will not be overturned for at least a year. Finish up your education!
2. The final fate of AB540 will rest on the California Supreme Court, which is likely to overturn the flawed decision from the appeal court!

I am a legal immigrant currently in UC Berkeley. AB540 won't affect me, but I have a couple friends are AB540 students. Today is a good news for those whose future are depending on it. =)

Dreamers will prevail! Go Dreamers! =)

I'm pretty sure anti-dream activist (racist/hate monger) tried this in other state and instate tuition always tend to win. I pray that it wins again. I can't emphasize how important this to dreamers. I finished my education only because of it and i hope many more people can say the same.

Actually, the CA Supreme Court is quite moderate to conservative with 6 out of 7 Republican appointees.

But yes, these are the people who also ruled for marriage equality 4-3, proving how out-of-touch anti-gay conservatives are on the issue.

That's what led me to believe that they're pretty liberal on social issues. If they voted for marriage for gays, why wouldn't they vote to allow us get an education? This is about equality, after all.

Two strikingly different issues Fish. Sexual orientation is a 'suspect class' under California law now, given strict scrutiny like race, sex, ethnicity. On the contrary, undocumented students are not given that classification, re: Plyler v. Doe, and I believe have never been given that designation. It's a legal conundrum for us.

(Of course I can go to the court and make an argument that I am undocumented only because I am gay and that would leave them scratching their heads --legal binaries are sometimes rendered ridiculous when dealing with intersectional/multi-dimensional oppression).

That said, there is enough precedent on the side of instate-tuition bill to let it prevail so keep up the hope.
