What schools are you applying to? It looks like you live in Cali... you need to tell the schools (assuming you applied to Cali schools) that you need fill out the AB 540 form. You shouldn't be denied just because of your status... I used my ITIN for every school I applied to and it was fine.

It'd be nice if you don't make duplicate threads on different sections to get more attention. It won't get you answers faster, it only annoys people.

it'd also be nice if people actually answered the topic question on the thread not leave rude comments....

anyways, the school could deny you AB 540 exemption if you have a certain type of visa, like B1 or B2, that you overstayed on...i don't remember, but that's what happened to my bf. He also got denied because of this.

On the California Nonresident Tuition Exemption Request, it states:

Quote:
Students who are non immigrants [for example, those who hold F (student) visas, B (visitor) visas, etc.]
are not eligible for this exemption.
Yet, so long as your BF does not hold legal status at the current moment, and so long as he qualifies under the rest of the requirements; at least 3 years in a Cali High, graduation / GED equiv, then there should be no reason that he was denied from paying at the in-state tuition rate.

If you're going to post critical information, then I suggest you do so with clarity, as to avoid any confusion or misinformation.

wow...i was trying to help out someone, with what i know of the situation and i get criticized? whereas K-Man up there, ACTUALLY criticizes someone about posting a thread twice and nobody says anything....

AND one more thing...if previously having a B2-visa isn't the problem, then why won't someone tell me why so many people have been denied from community colleges (being that they do have the rest of the requirements)?

it's nice of you to try to help. the fact of the matter is that if you're not 100% sure of what you're talking about, you could unintentionally mislead someone to disastrous consequences. you're not getting criticized for trying to help. i'm sure you understand. and actually, k-man can criticize about the double posting. he is a mod after all. besides, he's absolutely right. it is annoying to post two threads about the same thing. i'm not sure why he didn't just close one of the threads.

people's situations are different. you can't just throw that out there without any specifics. "so many people" is subjective. if you're that concerned about the b2 visa because of your boyfriend, i suggest you have him check again with the school. it truly helps to check with someone who is a bit higher up on the food chain. schools change requirements every now and then. you never know, he might be able to get in now if he wasn't to before. you won't know unless he asks.

Wow, you need to grow some balls. You're not getting criticized, he was simply telling you that you need to be clearer when explaining things as to not mislead people. I'm not trying to be mean. I am glad you're trying to help and that you're a legal citizen and support DREAM, but people are going to correct you if your post does not have the right information because some people might believe it.

And what he said is correct. As long as you're undocumented (if your visa is expired) and you meet all the other requirements, you are eligible for in-state tuition in California. Check out the link he sent you; nowhere in it does it say that you're not eligible if you have an expired B1 or B2 visa. Actually, nowhere in it does it ask you to write down what kind of visa you have.

I would call the school and find out why exactly he was denied, because if that was the reason, it is not a valid one.

They really shouldn't... at least they shouldn't because of your status. Unless it's something with academics, then I don't see why they could deny you. Can you be a little more specific? Did you talk to the school about it?
