i need help dreamers about requirments to qualify.

I came to u.s when I was sixteen and have a high school diploma . I have been living in u.s for 8 yrs and no criminal record and just because I didn't come here a year before I turned sixteen I don't qualify for this . I need to change this how can I do so?

You can't change the DREAM Act. Unless Durbin and Co. change the upcoming legislation to include people who entered when they were 16 and under, then there isn't a way you can benefit from the DREAM Act. I'm sorry about that... it really sucks for people who were 16 and over... but you have to look at it from the perspective of the Senators. If they include 16 year olds, then 17 year old will complain and so on and so forth. They simply have to have a cut off otherwise some senators wouldn't even support it. They could even lower the limit.

However, if CIR were to pass, then you'd benefit from that. Also, since you entered with inspection, if you find someone you fall in love with, you can get married and not have to go back to your country of origin during the process. You can stay in the U.S. and apply and it usually doesn't take that long to get a green card if you're married to a U.S. citizen. If you choose that route, get married for the right reasons and not just because you want to get a green card. It's illegal and you can get into a huge amount of trouble, both you and your spouse.

So they know exactly when you arrived the US.

hrvatica13 got it right, if you get married you will get a green card without leaving the US and you will get your work permit and a SSN about 2-3 months after you get married and file that papers (90 days tops).

Also, not everyone who came with inspection can file to change their status. People that came under the Visa Waiver Program (and few other visas) can't adjust their status.

This is a really unfortunate situation, but the 16 year old cut off point is not arbitrary. There was a thread about a radio interview done after Dream Act or CIR's defeat and an immigration lawyer explained (talking to a young man about Dream) that the US considers 16 year olds and above as a separate category as in not considered as a minor.

I tried searching for it, but I couldn't find it. It was about a young man wanting to join the military and he talked to his US born younger brother and said how lucky he was. They also interviewed an Asian American group and how people in the community were devastated over the bill's defeat. Does anyone else remember that radio interview?

hrvatica mentioned that you would be eligible for CIR. Dream might also be attached to CIR moving as one big immigration legislation.

EDIT: My memory is a bit sketchy. The way I remember that immigration lawyer was that immigration law or some other law says 16 year olds and above are not considered to be alien minors or something like that. The Dream Act focuses on a specific group of undocumented people, alien minors, and that is a set age group in some law. You can tell from the title because the Dream Act stands for Development, Relief, and Education for Alien Minors Act.

thanks guys i wish you guys good luck! i hope things work out for all of us. my dream is to join u.s army and i will acheive it. i know road seems pretty bumpy but i know the way. if anybody got a way i appreciate the help .

Hey, Guys How About My Case I Came To US 2002/7 With I-94, And I Born 1986/10 So Do I Qualify The Dream Act.....if It Is Count By A Year Then I Will Be 16, If Not I Will Still 15

Kenny... are you really asking this question? You've been on this forum for how long? You were technically 15 when you came here in July since your birthday isn't until October. You are fine.
