An interesting immigration case is winding its way through a federal court in Austin, Texas: A group of mothers has filed suit against the chief of the state's Department of State Health Services Vital Statistics Unit, because it has refused to give their U.S.-born children birth certificates.

The issue here is not whether or not these children are U.S. citizens. They are and that's made plain by the 14th Amendment of the Constitution, which says anyone born in the U.S. is automatically a citizen.

The issue in this case is what kinds of identification Texas can demand of their undocumented immigrant parents to issue a birth certificate.

According to the complaint, Texas is refusing most forms of ID that undocumented immigrants would have access to. In one case, for example, the Vital Statistics office refused to a accept a matrícula or an ID card issued by a local Mexican consulate....(read rest on the website)
Story was posted a while ago and I may have mentioned not really losing sleep over the anchor-children since they are after all citizens and in far better shape than anybody in here, but I didn't realize it was actually a deliberate plan by the state to pick yet another fight with the feds over immigration. Now that the undocumented parents have sued Texas, I will grab my popcorn.

So your parents get to stay here and collect welfare on your behalf?

Don't get me wrong, I'm not taking Abbott's side nor questioning the citizenship of the kids. He's obviously declared war on us (little man syndrome) but I don't think adult undocumented people do us any favor by coming here and having multiple kids on the state's dime. Or the pregnancy tourists. There is some crack down on them as well when they go get a visitor's visa.

Yea but by calling anyone anchor babies, you're using a derogatory term that offends a lot of people. It's like calling you a wetback. You will say, I entered with a VISA, it doesn't apply to me but it's a meaningless argument.

Many members of this site have children. Some adult activists have undocumented parents, some parents of DACA recipients will benefit from DAPA. My sister is not an anchor baby.

Now, with the fraudsters, it takes a lot of guts to jump the fence while pregnant or without a pregnancy. It's hard and dangerous. The wealthy Chinese pregnant women are not undocumented migrant workers falling in love with a dude named Jose. They came with tourists visas and were living in relative luxury while in the USA. Neither, according to one of NPR's segments, they weren't even planning to live in the USA in the near future. Rather, they wanted their kids to have the option to migrate in the distant future. That's one of the perks of money.

The girlfriend of el Chapo Guzman came to the USA also legally, had her baby and left back to Mexico. Both the USA and Mexico knew and took pictures and allowed her to do what she wanted and no one did a thing. That's one of the perks of impunity.

The reality is, rich ppl will do what they please and it will e unfair some times. That is not an excuse to scold people for doing what people do, getting hook and making babies, for the abuses of people with power. It is easy to punish a migrant worker who barely speak English, has low income and little education rather than doing what is right and fair. I guess, I am only asking people to have compassion, not only to themselves but to others.

You are furthering a stereotype that's not helpful.

Those are legal immigrants that come over on some kind of visa for example a tourist visa. It's not the same as illegal entrants. It's all completely legal, and statistically it's insignificant in proportion to all immigrants. It's just that the nativists like to highlight that particular birth tourist story to scare everyone and gin up anti-immigrant sentiment.

I get offended when people continue to use "anchor". The term is derogatory and it's not even based in fact. Citizen children aren't able to sponsor their parents until they are 21. There has been no proof established that there are people crossing over the border illegally for the sole purpose of having a child in any significant numbers.

When you use terms like anchor baby, talk about parents collecting welfare checks, etc.....YOU ARE DOING NATIVIST ANTI-IMMIGRANT GROUPS' WORK FOR THEM. Don't make their job any easier. Seriously people which side are you on????

Err uh. The problem is that the problem is much more widespread and the conservatives might have a point about it. A lot of undocumented people who come to my work has Medicaid but also have expensive clothes, cars, and iphones
