Question, we have a baby on the way. Should we apply now or wait for the baby to be born to establish hardship?

You need to have an approved I-130 before you can do I-601A.

Understood. The question is, should we begin the whole AOS process now? or wait for our baby to be born for hardship purposes?

Start the I-130 first, the process time is about a year.

Is your wife working? If she's not, I would apply already. There's already a hardship if she's not working and pregnant, she would have no income and need help during the pregnancy.

Okay. Good deal. Makes sense.

She will be going on maternity leave on November. So apply once that happens I guess.
