Can some who is married to a U.S. citizen apply for AOS if they entered illegally back in 2003 and left the country for 2 months in 2006 and entered again illegally? The person has DACA and travelled with AP to clear the illegal entry, but will the 2 entries be a problem?

2 EWI's triggers a Permanent Bar meaning they have to stay out of USA for 10 years before they can appeal to enter again but I have read others who were approved. I think it depends on those EWI evidence? This is definitely an experience lawyer route that specializes in this type of scenarios.

Interesting that they were able to clear the EWI with DACA AP (I guess it does not matter how many EWI's someone had). Either way, does this clear both EWI's?

They probably mentioned they only entered once. I can't see USCIS issuing a document for someone who mentioned they entered illegally twice. Permanent bar is permanent...there is no ten years!

You mean mention in the application that they have had 1?

Permanent Bar is Perm but you can petition to re-apply for entry after 10 years away from USA. No guarantee it will get approved.

Long time lurker here...

I am engaged to US Citizen and we are planning to have a wedding ceremony in about 1-2 years. Can we still file a while we live separately yet married on paper?

I mean I would like to live together but due to her career, we are living separately even though we are married.

my husband and i filed my GC application when we were living apart. we lived apart for about 3-4 months after filing the case due to us working in different cities. we had joint federal tax return to show as evidence. I dont think filing the case would be a problem but I was strongly encouraged by all attorneys I spoke to that we should be living together by the time our interview happens. Otherwise it will be an uphill battle for us to prove we are legitimately married. this was just the feedback i received so i suggest you get some feedback from immigration attorneys as well.

Hi all,

Today I had my I-130 interview with an immigration officer in downtown Los Angeles. Currently I have a pending deportation order that has been on hold since 2007. Due to that my case was not an easy case nor could we go the usual route in terms of filing al the paperwork together it had to be piecemeal. I-130 first then I-485 and then basically I would adjust through an immigration judge. He/she has to close the deportation order before I can become a legal permanent resident.

Interview:

Got to it 30 mins before my appointment. Was called in around 1 P.M. we introduced ourselves, my counsel introduced herself filled form G-28 and we carried on. I was asked to step outside meanwhile they interviewed my spouse. She was interviewed for 20 mins before they asked me to come in and she was walked out. They swore me in, asked how I was feeling and then they said they were going to ask me some questions. Asked for my name, wifes name, social, how long we have been living together, how we met, who lives with us, what the name of our pets are, etc. Then I was asked to be specific: "if I were to walk through the front door of your home, how do I get to the kitchen"? Who throws out the trash? Do you ever help her? Who parks inside? Where do you park, what kind of car's do the people who live with you have? Asked whether the signatures on the forms that my attorney submitted were mines and my wife's and then my wife was brought in.

Summary: we did not get an approval of our application, the reason being that the interviewer was in training and 2 other officers were their reviewing her decision or so my attorney said. The officer gave us a paper to expect a response within max 120 days from time of interview. My attorney said that we basically answered all the questions the same except for 1. And that it was so minor that it did not matter, and that it should not be a reason for denial of application. IF you guys have any questions please feel free to post or private message me.

By the way theirs a couple people asking here whether they would file while not living together. I would not. They are very specific on when you started living together and why you did or did not.
