DACA NEWS: The same judge that invalidated the memo that stops new daca application , has given time to both parties of the lawsuit to explain what is that they want and why can they do it or not. The lawyers of the dreamers have until 11/24 to request that immigration receives new applications and that the employment authorizations be valid for two years. The government has until 12/1/20 to explain their position. I will keep you posted.

Here are my take aways from the the govt brief filed in the Batalla #DACA case now. As a recap, the Court ruled on Nov. 14 that the Wolf memo gutting DACA valid was issued without legal authority. The question in these briefs is what the court should require the govt to do. /1

THIS JUMPED OUT AT ME. 65,800 is the number of 1-year DACA grants and work permits issued since the unlawful Wolf memo. That's 65,800 people who got 1-year grants unlawfully and now should get 2-year grants /2

Also, the federal government agrees that the court should now set aside the Wolf memo & that relief should run nationwide to the class certified of all DACA recipients & DACA eligible individuals. AND, the federal govt agrees this means DACA should return to its 2012 version. /3

But the govt notes that it reserves its rights to appeal the decision of the court. They also note that DACA could be changed by further agency action or Congress. So, now is the time to speak up in support of DACA & the need to pass legislation for permanent protections. /4

The govt disagreed with a bunch of the requests that the plaintiffs made to ensure the federal government returns the DACA program to the pre-Wolf memo version. This will be up to the court to decide. /5

When we get a court decision we will be updating this page http://dacaclassaction.org to get information out to all impacted folks. /6

So, there is no change tonight. The Wolf memo has not yet been set aside by a court order, but the briefing is complete and we now await a court ruling. We will update when we have that. But we do have more hope, created by the courage of DACAmented & undocumented leaders. 7/7

IMPT DACA thread. 2 additions:
1) High probability the Wolf Memo that shrunk DACA & stopped new applicants & AP is ruled invalid shortly.
2) Admin shows its *all-in* trying to kill DACA pre Jan 20, via Judge Hanen & eventually at 6-3 SCOTUS.

Threat is VERY real. Need legislation

“The Biden administration needs to be clever about this because there's a sadly decent chance that Judge Hanen strikes down DACA the same day the announcement is made,” American Immigration Council’s Aaron Reichlin-Melnick tweeted last month. “They should be ready to use alternatives, like Parole in Place or Deferred Enforced Departure.”

Feds need to indite Ken Paxton ASAP.

If everyone with Daca leaves the state of Texas before December 22, then the texas lawsuit is dead since they will no longer have the standing to bring the suit up. So hurry and get the hell out, I hear Florida is nice this time of the year.
