Just to correct this, AP does NOT overwrite the K-2 entry. If you entered in as K-2, and did not adjust with the original petitioner, the only way to get a green card is through consular processing,...

well, I don't think there is a path right now for DACA -> H1B officially. We will need to wait until the detail language show up to know more about it.

if you overstayed you visa, I think the path of least resistant will be wait until your wife got the citizenship, and then file for AOS for you, probably will take about 6 - 7 years. Current I-130...

Yes, i adjust through spouse. The interview is short and easy, just some basic questions. However, they did put me through the administrative process that lasted for about 4 weeks.

It is basically all up to the border patrol agents if they want to let you in or no. I will not risk to do an AP unless you have plan of never coming back.

It is the 2 fees you paid on your consular electronic application page. I believe after you paid these 2 fees, you can start the DS-260 form.

Are you talking about the I-601A application? I believe the fee they are referring to is the AOS and IV fee you need to pay for your immigration visa with NVC.
Mine was $325 and $120.

I am not saying you shouldn’t do AP. I am saying if you have a legal entry, and you are thinking about using the AP to overwrite your legal entry, then it is pointless to apply for AP.

I was entered with a K2 visa, and the rejection letter pretty much says the ap doesn’t overwrite the legal entry. Therefore They cannot grant me AOS.

That is not correct.
I recalled for the i485, you need either a legal entry or paroled in. So a visa entry is different compare to paroled. If you have a legal entry, uscis will use the legal...
