Agreed. I did not say overstayers are more deserving. Both class of candidates have equally pertinent case. But overstayers can claim to have broken less law. Thus making them more desirable

Im not to sure why you would want to do that?? If u get married to a citizen ill be way easier for you to become one and plus you will get more benefits than people who might get their papers from the dream act..

like i said, the whole point of the dream act is to not punish children for the crimes of their parents so the whole "overstayers broke less laws" argument is moot

A student visa abuser is someone who is on F1 status and attend public highschool at the same time.

The new INA §214(l) bars F-1 student status for aliens seeking to attend public elementary school or a public adult education program. An alien who initially enters to attend private school and then transfers to a public school (subject to the exception previously described) is deemed to have violated F-1 status.

Under the new INA 212(a)(6)(G), an alien who obtains F-1 status and who violates INA §214(l) is excludable under the alien has been outside the United States for a continuous period of 5 years after the date of the violation. [Applicable to aliens who obtain F-1 status 60 days after September 30, 1996 (i.e. November 29, 1996), including aliens who extend their stay after this period.
