Here is a link of someone being hit with the same "crime": http://www.expertlaw.com/forums/show...t=25692&page=1

Here is the actual crime:
Quote:
class 1 misdemeanor VA crime code ASL-1315-M1 and code section 18.2-57.2

Your case is very different, you are out of status. She was taken because there were scratches on her boyfriend, that is when they take someone to jail, only when they see signs that something did take place, visible scarring, you mentioned you did not hit her, you pulled her hair but that there was nothing visible, in that case either there was something visible or your sister tried to make it seem as if there was something visible, i.e., scratch her self and say you did it.

seek a lawyer, I am not trying to be an alarmist, but I have heard of so many cases turn so bad because there was no lawyer present.

^ which is what makes this so very weird. I would expect a guy to be arrested for hitting his little sister, but a sister hitting a sister, its like a brother fighting with a brother, its almost expected.... Now to top it off with the fact that you only pulled hair and did not hit her...

Hello starNmoons!

This is a very sad situation but unfortunately you are living under your parents’ roof until you move out. I’m not a parent but I think discipline is for parents. Properly disciplining teenagers is complicated. They are not adults and they are not children (even though sometimes they act like it). Minors need structure. They need rules and consequences. From infancy to adulthood, they go through various “phases”. Patience is very important but so is standing firm on the ideal behind a rule.

You need to be assertive, don’t say it in an angry manner but be assertive and then maybe she will give you the respect you deserve. I highly recommend assertive communication.

I feel __________, because I __________, therefore, I need __________.

Example; I feel upset, because I tried to help you, and you yelled at me. Therefore, I need to know you're not going to yell at me the next time I try to help you.

(Don’t get into specifics. I.e.: “That time you stole money from me.” It will only open the door for her to rationalize/justify/excuse her behavior and find some way to blame you for her short temper.)

_____________

If she doesn’t listen, say:

“I’m sorry this conversation is finished until you can learn to treat me with civility.”

“I’m sorry, I do not agree with the assessment of this situation. We will talk when YOU calm down and not until.”

You have a bottom line and the bottom line is being treated with respect and civility you deserve.

I sincerely hope everything goes well.

^Ha ali, i probably should have.

Anyway UPDATE: Okay last week my parents decided they would help me get a lawyer and they took the papers that were given to me. On Sunday night as asked y father about the lawyer thing and he went on about how much money it is and how selfish I'm being. So anyway no lawyer from them. And honestly I cant afford one. I asked him to give me my papers back to see if I could get a public defendant it took him two whole days. I have it now and will try to get a public defendant, although I don't know how hard it will be to get one. Will I have to and should I disclose my legal status to the people? The court case hearing is this Friday so I will have to act fast. I'm pissed cuz if I knew that they weren't really going to do sh!t I would have went about getting a public defendant by now. I don't know if I even have enough time.

So wait, if you're being selfish to defend yourself, what is your sister being????

There are law forums online that are a lot of help in issues like this.

expertlaw.com is one.

Thanks Invictus. When I go on the board to talk about my case, should I bring up my status? thanks again

Another UPDATE: So I called the public defendants office and they told me they need a 10 weekdays heads up before they can get me a defendant. Right now Im looking for work, and with my status, I hope that I will be able to get a defender.
