I am guessing you chose option h, if you read the instructions there is a table of possible exemptions on page 6. The one that would apply to most is 1b or 1c, we usually need it for bank accounts. You need signed forms and such from the bank that confirm you need this.

You can also choose option d if your parents have an ITIN and want to claim you as a dependent when they file taxes.

The simplest way would be to pay taxes along with your W7 and choose option c.

I don't know where you can find updates on the 287 (g) program, just google your town and 287 (g) or call your local police department. You don't have to worry too much about it if you are a careful driver.

Hope that helps.
Thank you. Now I know how to fill it.

It doesn't seem like that 287 (g) is a big deal. I like that blog though.

Those forms are so confusing, according to the IRS definitions some undocumented immigrants are resident aliens in their forms, but most people go by the definitions within immigration law and end up confused about which option they should choose.

Anyway, good luck with all that bureaucracy!

Ok. I asked an accoutant who is a tax return specialist, she told me that in order to get an ITIN I'll need to give the IRS a reason why, to get a Driving Privellege Card is not a reason, they want a tax reason.

So, if I open a saving account in a bank - I will get interest on the money I have there and this is a good enough reason for them to give me an ITIN (because I have to pay taxes on those profits and they won't prevent me from paying taxes).

So you fill this form (form W7), and then you attach to it a signed letter from your bank that says that you've got a saving account there and you need an ITIN so you could pay taxes. Also a attach a document that shows that you got a saving account and you are good to go, your application will not be rejected for sure if you do it like that.

You will get that number after 4-6 weeks (by the IRS website) but I been told that it takes 2 months.

I'm almost sure that we need to choose option "C".

For an ITIN? maybe it all you needed because your parents put you under "dependent".

If you are not a dependent (like me) you'll need to file a seperate tax return. To get an ITIN you need to prove the IRS that you need to pay taxes because you have an income (saving account interests = income).

You can open a checking account without an ITIN. If you want to open a saving account and they ask you for an ITIN then tell the bank for a letter that you need it and attach it to the W7 form and send it to the IRS, I think thats enough for them.

In Bank of America you can open a checking account only with an ID, you don't need an ITIN unless you want a saving account. You can call Bank of America and check.
