If you came here legally, you don't have to go back to your country of origin; you can adjust status in the U.S. If you came here illegally, you do have to go back.

Go to immigrate2us.net for more info on adjusting via marriage.

I have a quick question. I been in the US since i was 9 yrs old. I came in to the country with both my Visa and Passport my family and I just seemed to of had over stayed. I have attended community college and quit knowing that i can't go far since im not legal and its a hassel building all that money for tuition with no Credit history. I know have my own car, Legal Drivers License, Bank Account and I did that all cause of my ITIN from the IRS... so yes i have been working Illegaly but yet i been reporting my taxes every year. I have no criminal background nor have i been stoped but yet only one time from speeding. From my understanding im consider a resident but yet not legally for been in the states for more then a decade. Im 25 yrs old now and its getting harder and harder for me. Is there anything out there that would actually help me on becoming Legal for my 16 yrs on the states? I ask opinions and all i hear is wait and wait.. but i been waiting for many years... how much longer do i have to wait?

Question,

what if you get deported and/or leave the US and THEN find yourself an American spouse outside the states. Can you come back to America and become legal through marriage?

You can have your fiancee apply for you, but you will have to stay abroad until you get a visa.

Getting married for the sore purpose of becoming legal is one of the most opprobrious things you can possibly do. But if you are doing it for love, then i guess it's understandable. I didn't rly read the beginning of the thread, but i will once i get some sleep and then post more comments.

Since his aunt adopted him, she should've filed papers for him to become legal at that time. If she didn't, I'm not sure if she still can. Hopefully someone with more info can reply, but he should ask his aunt if she filed anything on his behalf that might help him.
