Well, the way I understand it, its optional right now for companies that do not have contracts with the U.S. Government. Plus there is a list available online of the companies that participate in E-Verify. You could check that out see if the business appears on there.

I've been blessed to work at a medium sized company (about 50 permanent employees + countless temps that are always there). They never asked for any of my documents (being related to an employee didn't hurt either). I've been there close to 4 years now. Don't lose hope. Just make the calls. True true. Some companies are pretty clear about that right from the beginning. The Pizza Hut right across my street has a huge sign that says "We Support E-verify" so you'll know right away that you'd need legal papers to work there.
