Excellent Thread!

I have a question though....my father filed for the 245i before April 30, 2001...but unfortunately left the country after he filed it....do you think there is any way this case can be opened again, so that me and my sisters can get legal status some how. He left the country and has a ten year ban. i dont speak to him anymore.

wow, what I great work. this is a worth it information.

Regarding what you wrote in migrating to Canada, you are absolutely right!
I tried to apply for a canidian visa as a skilled worker; unfortunately I fall short on points. Like you mentioned, at first glance I totally belived that it would be much esier obtaining a visa to Canda but it is not. I have my degree, I am trilingual but I don't have any experience in the US due to my emigration status.

Since his aunt adopted him, he should be able to do something about it. My advice is to ask a lawyer. Only they would know the answer to this and are certified to give legal advice.

C. 245(i)
On December 15, 2000, Congress extended the provision 245(i), which allowed those unlawfully present in the US to adjust their status in the country, until April 30, 2001. This means that if a petition (I-130, I-140, I-360) was filed for you before that date, then you are grandfathered in under the law and can gain lawful status if you pay a $1000 fine. In order to qualify, you have to have been present in the US on December 15, 2000.

Please Help!!! Can I adjust my status if I have been present in the USA on December 15, 2000 and may find a sponsor? Who is still eligible for this provision? What does it mean - grandfathering?

hello pingpong abyss. i personally want to thank you for postin all this valuable information here. and ask you a question. i am 24 years old, currently hold a bachelors and master's in civil engineering from ucla. i came to america when i was 13 years old, like all the other dreamies my parents brought me. so my question is, i enter with a visa which was not mine, once i crossed the border in san diego the "coyote" took it away from me. if i get married with my fiance, how can i prove i enter with a visa, so i don't have to leave the country? can i file from inside the U.S.? thank you!!!!
