Yes! I definitely agree about keeping in touch. How many of us are there with the F4 April PD?? Like four or five, right?

@Rolox: At the very least, I recommend talking with a lawyer. You can probably get a free consultation, just be cautious because there are some very vicious lawyers out there. I'm thinking of getting a new lawyer, bc my old one didn't even know whether CSPA applied to F4. I heard someone say something about attaching a memo about CSPA to explain your situation. Also, you probably know this already, but you have to apply within one year of an available visa number to get the benefits of CSPA.

My case is JUST like yours. I asked a lawyer on a page that isn't working right now but I'll copy/paste the link when it's up again. He said that it's a good idea to attach a memo reminding them to consider your application along with your father's. I'm pretty sure we qualify for it (I'm almost 22) depending on how long your I-130 took to get approved and how long you waited for the visa to become current. I waited about 4 or 5 years each time (long long wait!) so my CSPA age is like 18. Try using a CSPA calculator.

I will NOT be using a lawyer because I absolutely can't afford one and because every time my aunt has consulted one they try to scare her into paying them "if I do it for you this will work out... otherwise it might not" so honestly I don't trust them that much. If I get denied I hope they don't deport me, but I'd appeal it because I know I qualify for it.

Yea, I mean my lawyer knows about forms paperwork interviews etc... But he also didn't have much knowledge about CSPA, for a second I thought I was doing his job but at the end of the day I don't mind because I might be helping him out with a similar case. I had two consultations with two respected firms in downtown New York. One was $80 and two lawyers very knowledgeable told me not to worry about it because according to them I qualify with ease, it took my petition almost 9 years to approve so that would make my age almost 12 years old. The other consultation was over the phone and this lawyer really impressed me by her experience and knowledge about cspa and after giving her my info, she told me that I also qualify. But she is really interested on taking my case, but my family has already paid the current lawyer. What I plan to do is to trust my current lawyer, after all, I have gathered enough info to feel quiet comfortable with my case. In the worst case scenario, if during my interview my case is denied then I plan to use full artillery and hire the best lawyer available to reopen the case and make the law count. As I think, if the law protects us, someway or another it has to be respected and followed. That's my game plan at this moment, my lawyer also said about attaching a memo about the cspa, it looks like we are all in the same page =]

So, we spoke with our lawyer today. And he said that my Mom's I-130 approval was great, BUT we'd have to go back to Jamaica to pick our visas up. Surprise, surprise: 10 year ban.

The only bright side was that he said that he's had success with people in our situation immigrating to Canada. I figure, I'll try to finish up school here and try to pursue immigrating to Canada probably within the next 18 months, pending the situation with CIR by then.

Hope some of you guys have better luck with your cases. =]

So your mom's petition wasn't done on or before April 31, 2001?? I'm sorry to hear that :'( Hopefully the Dream Act will pass soon (even though I'd be a million times happier with CIR)

Thanks for the love, guys lol.

I'm going to start looking into going to Canada, pending what happens in the next 18 months. He told me it would have to be a permanent move (not just trying to get a student visa to go to school there) and from what he knows of Canada, they're much better than the UK when it comes to immigration. He put me in touch with someone his firm works with on a regular basis to see if she can help us leave. I've already emailed her, so once she emails me back and tells me what my options are, I'll post it.
