In case TheDem doesn't reply here - We have PM'ed each other and his process was much more complex than any of ours and he was approved with no problems. I believe it took him about 3 months for the whole thing which is pretty standard right now. Of course it depends on how busy your "ASC and Office" is. I hear some are so packed they have long backlogs.

Thanks for the link. I need the W2 from my uncle (since he's the sponsor), it took him a month just to send out his tax returns. I spoke to the lawyer and he said to not pay attention to the letter and that the EAD will not be hindered by the stop. I guess only time will tell. My general timeline has been two weeks, so I'll see if anything turns up by the end of this week.

Hi everyone just got confirmation that I would need the W2 forms to proceed with my case. This will probably cause a delay for a couple of weeks, I have waited fifteen years so what's another month right? Thank you for your wishes and best of luck to you guys as well. I'll keep you posted!

They will resume progress AS SOON as they get what they need, so mail them ASAP! I've seen people who got the RFE on day 1, mailed it overnight on day 2, USCIS got it on day 3, and on day 3 they saw activity again. So definitely send asap asapppp!!

Well I submitted the w2 form to the lawyer and he came up with this brilliant bs. It's kinda long so I hope you can bear with me and provide some insight. When we filed for our case we paid $5,000 in filing fees (five family members), these fees as far as i understand were for filing for AOS. After our biometrics we got the rfe notice for all of us, for FOUR of us the notice stated that we needed to show the I94 or the visa stamp and the W2 forms along with $1,000(this I know is the penalty for overstaying). Here is where it gets a little complicated, my dad came here back in the 80s and he was issued an ss #, he has a work permit and he had sent in a copy with the application package. The notice that my dad got just says that he needs to submit the w2 forms no penalty, nothing.
The lawyer's theory is that since my dad had his I94 he did not have to pay the overstay fee. He says that if we prove that we were entered legally there is a chance that we will not have to pay the penalty. My argument is the penalty is for overstaying not whether or not you have entered legally. As for my father not having to pay, I think that since he was working here legally the payment for AOS in his case was unnecessary therefore they applied that grand to the overstay penalty. I have urged my parents to just follow the instructions USCIS has provided us with, I would appreciate it if you can give some advice on what course of action I should follow.

1) were you and your family here illegally?
2) did any of you work w/o permission?
3) did any of you overstay your visa?

Both Renzo and I (and our families) entered legally, but since we had illegal presence we still had to pay the $1000 penalty. The penalty covers you if you did any of the points above ^^ (1-3). Your father never accrued illegal presence so he's probably fine (you said he worked legally) -- bud did the rest of your family..??? If you didn't do any of the above (work w/o permits, etc) you don't have to pay the penalty fee and you would not be applying through 245i.

I highly doubt this. If anything, they didn't charge him for the 245i application, but EVERYONE, whether here legally or illegally, has to pay for the i485 application.

Hopefully I'm understanding your case, it's past midnight here and I'm extremely tired

Update meeeeeee like always please!! As for our case, we're still waiting for the EAD :'(


P.S. I'm concerned your lawyer didn't make sure you sent the correct fees and paperwork from the very beginning...

Thanks for your reply. My family and I were here legally and overstayed. My dad and sister, who is a minor, have received their rfe but nothing has come yet for my bro, mom and I. Checked the status online and it said that they mailed out notices on November 4th for all of us, I called USCIS and was advised to wait two more weeks before inquiring. As for my dad and sis, their rfe has been sent in so let's see what happens. Told the lawyer to just follow the instructions on the notice, funny thing though, the rfe is being sent to him which I found odd I was thinking that we should have gotten a copy atleast but nothing. Oh well, fingers crossed and hoping for the best. Good to hear that everything is going smooth with you.

Hey silver how are things?? did you get the RFE's? did you respond to them? My dad and I got the interview letter today. It's for December 29th. It's so surreal right now... update us when you can!
