What about possesion of marijuana (misdemeanor) and a criminal trespass (violation)

i think the law is pretty straight forward, if the crime you are convited of carries 1 year or more of jail time you wont qualify. if its less than one year you're in

You also don't qualify if you get 3 misdemeanors that put you in jail for 90 days.

They speficifically mention drug charges in the DREAM Act.

It may only be one offense, and the amount that you have on you has to be under a certain weight, I think 30 grams, not sure.

If you had more, you are disqualified, if you are caught again you are disqualified, if you are considered to be addicted to a controlled substance you are disqualified.

Marijuana is not a controlled substance, or else I would've heard that term in my hearing, plus it was a small amount. So wait you're disqualified if you've gone to jail? What about if you were required to pay a fine and no jail time? Would that still be considered?

In California Marijuana possession is in a unique position - it is currently a misdemeanor with a fine of $100 - no jail time. After Jan 1 it actually goes down to a simple infraction ( like a jay walking ticket )

As it is now it is a misdemeanor - BUT - the offense is taken off your criminal record after 2 years ( unlike other misdemeanors ). The problem with this method is that some counties never take it off their records ( because of time constraints ) some counties take it off, and some counties have a policy of never recording it at all.

You should run a criminal check on yourself and find out where you stand. I assume the immigration department can still find out what was on your record at any point in your life -- but you should at least get an idea of what is in your county record.

Other states obviously have different laws

And I'm not a lawyer, so take this with a grain of salt - it is just something that comes up in my job a great deal.
