Petition Parents!!

ok so my parents are living here illegally. i am turning 18 in a month. When i petition both, how long will it take? i know its a ten year wait average... but in the mean time, do they get work permits? or those have to b on wait as well? ive heard wait can take 3 to 6 months. some say ten or more years.. so if you know please clarity. im mainly speaking of their work permits!!! thank you.

I think it varies from person to person. Some get really lucky and others don't.

Good luck with everything..

How do the rest feel about it. Isn't this one of the major arguments against the dream act??

1. A US Citizen must be at least 21 years old to file an I-130 petition for permanent residence for their parents

Honestly,The highlighted is dangerous thinking.There is nothing "lucky" about it as there are prescribed rules that are already laid out,it is not the Green card lottery !!!!!

Lol,If that is you in your avatar you look older.To answer your question it would depend on several factors and each of the following is required for them to be able to adjust within US territory.

-Your parents must be under 245i or came in with a visa initially but overstayed[VWP excluded].

-You are a US citizen.

-You are at least 21 years of age.

-You are making in excess of 21,000 in yearly salary to support both parents.[Affidavit of Support]

If the following requirements are not met you can do nothing,if they have been met then generally 6-8 months depending on location.

My sister's petition for my parents took about 3 months, really dependent on location.

If they are not overstay or covered under the 245i, then their legalization process gets a bit more complicated and they would have to apply from their countries, which unfortunately activates the 10-year ban.

What I find funny is the last requirements, making in excess 21k per year to support your parents when they have already been living in the country and are most likely self-sustaining already.
