However, once you turn 18, you start to accrue presence. By 180 after your eighteenth birthday, you will have acquired a three year ban from the country, which will be initiated once you leave the U.S. Once you have accrued one year of unlawful presence, that will become a ten year ban. If you leave the country while you have the three year ban and attempt to enter within three years, the ban will become a ten year one. If you leave the country with the ten year ban and attempt to enter within ten years, that will become a permanent ban and will not be waivable until you have been outside of the country for ten years.
Gah! I'm lost now! I'm still 4 months away from being 18.5 years of age so can I still leave without getting the ban?? Your explanation just completely confused me lol

If you've already graduated HS

If you're not in college

and have no boyfriend

no attachment to this country

I would recommend that you leave now unless you want to get into this big mess all of us are in

Unless you have something worth staying for, like solid plans for college, etc.

I know I would never want to give up my current education, but I guess you're not in college yet. Compared to you, I have so much more to lose in this situation.

And if you're an EWI you can try getting married

But besides that, you can leave and try coming back sometime in the future

Just my personal opinion - don't let me decide anything for you.

I'm a dude bro...I'm straight lol

The only attachment to this country right now is the fact that I am in community college, but I just started on my first semester. Other than that...just my family and friends. But isn't harder to get your status straightened out if you're en EWI, which I am. So I can still leave without getting the ban right?

According to the explanation that I posted in this thread, which I got from another thread here, you're okay until you reach 18.5.

Sorry, I made a mistake. I meant if you're an overstay you can get married to adjust your status.

So since you are an EWI, there's nothing you can do but wait for the DA.

I so wish my irresponsible mother had informed me of this while I still had time to leave.

Talk to a lawyer about your case.

While it is true, one can leave before the age of 18.5 without without enacting the ban, coming back legally will be considerably complicated. Particularly exacerbated by the fact that they have been present in the United States while undocumented and may find it considerably complicated to prove that they will not overstay if given a Visa, whether it was a student visa or a tourist visa, to the United States and since the information is shared by some countries as an effort to enhance security, also other first world countries.

There are many lawyers out there that will give the first consultation free of charge, you can get a ton of information on that first consultation that should be able to answer your questions as far as where you stand. Don't make a drastic decision without consulting a qualified immigration lawyer, and after you talk to a lawyer talk to a few more (there are some immigration lawyers that are notorious for doing a very poor job and many have been known to scam vulnerable individuals, which it's why you try to consult multiple, I think there may be an organization that has been working on creating a list of reputable immigration lawyers for distribution among the immigrant communities, I know at least of one in existence in the state of Illinois, which I will load up soon).

Alright thanks. I really hope you're wrong about the whole being consideribly difficult to return to the U.S. legally. But wouldn't they more leniant on us since we already know the nation's laws and are basically already assimilated?

If they are giving you a visa they want to make sure that you will return to the country and not overstay. Pretty hard to prove if you have already been deported once from the country or had been undocumented in the country.

EWI stands for Entry Without Inspection. Basically, entering illegally, most likely through the border. Other undocumented immigrants are generally visa overstays--that is, they entered legally but violated the terms of their nonimmigrant visas.
