so i called my lawyer who has handled my removal case for years. The secretary proceeds by asking me a series of questions and tells my im not eligible because im not currently in removal proceedings. I also believe I have a final order, but she said "yea as far as i know you have to be currently in proceedings" is this valid?

No she is dumb. This is a sign you should get a new lawyer more capable.

She's wrong. There are the outlined requirements. Below that are different circumstances. One of them deals with the fact that someone might be in order or removal, in which they can appeal if they qualify under this order. At least that's what I got from it.

You just said he handled your "removal case". So aren't you considered in removal proceedings currently? Confusing shit but clearly some of these paralegals/lawyers haven't studied this well enough to form an opinion. We are eligible.

i was in removal proceeding, got voluntary departure, then appealed it. I dont know where i stand with that now. my dad handles all of that, and i just try to not even involve myself because i get bad panic attacks. I knew she was wrong because i read this on friday......
Does this policy apply to those who are subject to a final order of removal?
Yes. An individual subject to a final order of removal who can demonstrate that he or she meets the eligibility criteria can request a review of his or her case and receive deferred action for a period of two years, subject to renewal. All cases will be considered on an individualized basis

First of all the assistant aka paralegal cannot determined if you qualify or not as that is legal advice and she is not obviously an attorney and cant give such advice.

People please log into AILA website and find an attorney who is currently part of the AILA they were part of a seminar last week and trained in this new deffered action.

i applied for a work permit just like my parents. once i wasnt eligble i got a notice to appear. i have the cleanest background you will find.
