(1) Entered without inspection before June 15, 2012

how do you prove this? or do you not have to

and I've been reading through several posts and I have a question:

Should the checks for the application and biometrics be separate or should it be one check for $465?

thank you! there is just so much anxiety

Unless you have a picture of yourself crossing illegally, there is no way you can prove you entered without inspection other than you have been in this country since that point entry and there is no documentation of you entering the country.

Here's what USCIS says about the check:

Quote:
We suggest that you use a separate check or money order for each application in the package and biometric fees. If a single check is submitted for multiple applications and one of the applications must be rejected, then all applications will be rejected. The Lockbox can not accept overpayment and make partial refunds.
From my understanding we are only paying for one application (i-765) and biometric fee, so it would only be one check.

Okay thank you, so only people who came here legally but had their status expire would need to provide evidence.

A lot of confusion about the checks but thank you for setting it straight. I guess it is only one application.

No. You also need to prove by providing them any documents such as school records, receipts, medical records etc. showing the date on or around your said EWI.

Usually overstayers would already have this proof on their I-94. If you're an EWI and you have no record of coming in, then the best proof you have are school records/medical records/bank statements etc. that shows you were here before that date.

Yeah I can prove that I came before I was 16 before 2007, but I was just wondering about proving "entered w/o inspection before June 15, 2012" because it is listed as the 1st thing you need to prove on the instructions PDF

You're either inspected or not, EASY.
If you came inspected you have a VISA with your name. If you do you specified on the form and provide that proof to show when you became out of status.
If you didn't you don't have anything. No need to show out of status on 6/15/2012.
