My sister sent her application and she's currently enrolled in GED classes. She did her biometrics on Sep 27th so we are hoping for a response next week or the following. She sent enough proof including receipt of enrollment in the classes.

It says clearly on the USCIS website that one can be currently in school obtaining their GED and still qualify for DACA.

Q3: How do I establish that I am currently in school?

A3: Documentation sufficient for you to demonstrate that you are currently in school may include, but is not limited to:

* evidence that you are enrolled in a public or private elementary school, junior high or middle school, high school or secondary school; or

* evidence that you are enrolled in an education, literacy, or career training program (including vocational training) that is designed to lead to placement in postsecondary education, job training, or employment and where you are working toward such placement, and that the program is funded in whole or in part by federal or state grants or is of demonstrated effectiveness; or

* evidence that you are enrolled in an education program assisting students either in obtaining a regular high school diploma or its recognized equivalent under State law (including a certificate of completion, certificate of attendance, or alternate award), or in passing a General Educational Development (GED) exam or other such state-authorized exam, and that the program is funded in whole or in part by federal or state grants or is of demonstrated effectiveness.

Well she does have enough proof for all the years except 2010(February - November) and for the year 2012 she has proof she filed her tax return in March, she has her wedding receipts for April and proof that she started renting an apartment in May. I had called an officer from level 2 and they did verify 2 weeks ago that currently in school also applies for a GED program. That came from an officer that's level 2 already. My sister doesn't have a bank account. She however has had a cellphone plan since 2009 but it's under my mom's name so I'm not sure if that helps. I feel so bad for the little girl. Be in my shoes as an older brother/sister. What would you do if you were in my situation and had a Lil brother or sister and they didn't have enough proof? I'm doing my best to help her now so I thought of this forum and all of you going through the same. When the lawyer told my dad, me and my Lil sister to just give up, my little sister started crying and the lawyer seemed like she didn't care or felt compassion. I was so mad two lawyers have said the same thing. In my case, I never give up. I don't wanna give up on my sister and I wanna help her now since those lawyers did nothing to help her and now she's depressed thinking her life is miserable and that she is not as good as me and my other sister that's 23. It hurts me so much to see how much this whole DACA os deteriorating heR life. Im

I think your sister should send in any evidence she has, if for some reason that evidence wasnt enough, the worst they can do is request and RFE and if they did, if I were her, I'd request an interview with an immigration officer to state my case and perhaps move the case along faster. She could then use you and your other sister as witnesses that also applied for DACA and Im assuming you have enough evidence.

I would still go hardcore and try to pass the GED. DACA is a process so important that you don't want to get caught up in process limbo. I took my Biometrics almost a month ago and i'm still waiting. Imagine if you send final proof of your GED and you're still waiting for them to check it for months on end. The process is supposed to slow down more and more anyways.

Yeah I keep hearing different stories. To send after Ged completion and to send as currently in Ged program. So many mixed answers, but I think I'm gonna do that what itze said and the worst that could happen is an REF which should be a good thing anyway. And yes I have way too much proof about me including my other sister. We both have degrees. In wonder why the little one didn't wanna follow our footsteps. I did my biometrics on the 18th and yet I'm still waiting lol. Some girl at my job got approved in only 11 days after biometrics so go figure. This girl completed high school and has only been here for 7 years and her English is 20% good. But who knows, I guess it depends on the officer going over it huh?

There is a lot of misinformation on this thread. Your sister only needs to be enrolled in a GED program. It says so on the official USCIS FAQ page! There is no question about it.

Tell her not to give up. She should find like medical records, ask for video tapes from the stores she visited that year, bank statements, maybe ask friends who are us citizens to write letter saying shes been here all these years, and tell her to get the tax returns notarized because if they are not, she will get an RFE letter. Just collect as much information as she can and send the applications, with the help of god everything is possible. She wont get denied right away, if they need more info, they will send you an RFE letter. Im telling you all this because i sent mine on june the 15th, i did my biometrics on sept the 12th and on sept the 12th, they sent me an RFE letter asking for more evidence from 2010 to 2011 because i had just sent my taxt returns from that year and were not notarized. Thank god i had plenty more edidence from that i sent everything i found on my name and now im just waiting for them to update my case. So i hope this helps and just dont give up with your little sister. Good luck to your little sister.

Don't give up just keep searching no matter what some lawyer told you. Have you been to a non-profit that helps with the DACA process? They might give you more ideas and be less "bitchy".

Tell her not to give up she has not been denied which is probably the worst that could happen. She has done nothing wrong and should just keep searching and stay positive.

Dont you have to be currently enrolled in school or graduated? I thought that was one of the requirements.
