Dont rely on the information that people give you here. It's unfortunate that lawyers wouldn't help her.

The guidelines say your sister qualifies. That's kinda the point, make people who dropped out go back to school. Your sister shouldnt have to wait till after she gets the ged.

Get some affidavits for her presence in 2010 and focus on finding evidence for June 15. Remember it doesnt have to be the exact date.

That's the thing, affidavits from where? The lawyers told us that will not help but then again people have sent them to fill in the gap of no presence. What's a good reliable affidavit saying my sister was here from FEBRUARY-NOVEMBER of 2010?and also I didn't know the w2 forma had to get notarized so thanks so much for the info, I'll tell my dad she has to get it notarized. And yes she does have a Facebook and she has had a cellphone plan for 3 years now but it's under my mom's name. Not sure if that helps.

As some other people have said she should send whatever she has and might just get an RFE if they think she is missing something. I only send out 1 evidence for 2010. I took a tax class at H&R Block so I send the completion and certificate I got from them.
For proof for june 15 I sent my bank statement. I was in such a rush that i send the wrong bank statement it was for the month of march but I was still approved.

Affidavits from, (at least 2)
Preferably us citizens, ask coworkers, friends, landlord, etc any one that knows she's been here.
Have her husband and you and your other sister write one as well.

I really believe your sister has everything that's needed.. The gap is not that important
Main criteria is to come here before 16 and to prove that you were here
on Apri 15. Send in what you have.

USCIS FAQ,
Q1: May I file affidavits as proof that I meet the guidelines for consideration of deferred action for childhood arrivals?
A1: Affidavits generally will not be sufficient on their own to demonstrate that you meet the guidelines for USCIS to consider you for deferred action for childhood arrivals.
However, affidavits may be used to support meeting the following guidelines only if the documentary evidence available to you is insufficient or lacking:

A gap in the documentation demonstrating that you meet the five year continuous residence requirement;
