i was arrested for hopping the train in new york city back in 2008, went thru the system without having any identification or social security number, plus i was visa overstayed which makes me illegal, they fingerprinted me with mug shots and served 48 hours in central booking downtown Manhattan, i had 2 FBI detectives investigated my background check and took every little detail about my life, than was provided a free court lawyer who defended me and than was dismissed by judge my conviction was time served and 6 months probation, and this happened almost 5 years ago, and look at me now DACA approval.
i never mentioned it in my DACA Case, and i was never worried about it untill i got an RFE, i started shacking up it might be it, and than was relieved that RFE had to do with con't presence, and its up to your biometrics, they decide whether u have dirt in ur record or not.
what i can tell is go and apply with no fear.

All you guys with incidents in your youth gotta figure out what actually happened with your cases because I'm sure when you are young, you barely know what the difference is and how the incidents are reflected in your records. You have to do this if you're unsure of what happened and then read the guidelines on the USCIS again with that info.
