She said it was ok, that they don't really use middle names anyway so they left it out and my SS card has my name on there correctly. I also believe other people have been able to apply for one and they have just been advised to go correct their name in the SS system once they get the corrected EAD. It is really at the discretion of the person you get at the SS office.

Update the website shows my status as new card is in production, allow 30days to gert your card 
It says as of February 20th your new card is in production.
Not sure if its coincidence or not but its the same day that my lawyers letter was recevied by USCIS, stating that we had sent the card back about a month ago and to make the correction. Im thinking it worked.
