I wouldn't have mentioned it. If you leave then you know the risk youre taking. Sucks but that's the way it is.

To all the people who say isnt brief!!! Fuk you

I been here for 15 years and for someone leavin for 5 months shouldnt be consider not brief..
I left the US for a few days in 2004 during a summer break in high school and not for ~150 days. Your absence won't be judged against the time you've been in the US continuously, but precisely how long you've been out of the country.

Quote:
For purposes of evaluating whether an absence is brief, single absences in excess of 90 days, or absences that total more than 180 days in the aggregate will be evaluated on a case-by-case basis. An applicant must establish that any absence from the United States was casual and innocent and did not meaningfully interrupt the period of continuous physical presence.

How do you fly to Italy?? Where you in status when you went to Italy or where you out of status? I don't get it. Really explain. I assume most of us are out of status or straight up undocumented. how in hell does someone exit the country and enter knowing they will be barred?? That's not an innocent departure. Your departure wasn't innocent. You had a PURPOSE! period. You had a plan, a mission. Know that risks. I think everyone here without status knows the risks of exiting the country and entering again. There are risks to everything and you decide to take the risks then bravely accept the repercussions. its simple.

FYI:

brief
/brēf/
Adjective
Of short duration.

5 months is NOT short. That's almost half a year.

At least you are trying and you won't get deported if you get denied. The good thing is that you'll most likely qualify under the DREAM portion of the current CIR bill.

How did you fly/ get to Italy?? How did you come back here??? That's the issue too. It's very well known that if you are undocumented and are our of status and you leave the country YOU WILL BE BARRED for 3-10 years. That's a huge risk I personally wouldn't take. I lived most of my independent life taking cabs because I couldn't drive and it sucked but.... going back to my home country for 5 months and essentially live there was not an option.

If you are a minor, your parents have strong ties to their native country, you all have current visas, and you keep your mouth shut when you come in contact with CBP, then you shouldn't have any problem reentering the country.
