Hello all,

I have been approved for DACA and got my state ID. Now, I plan on going to travel to Hawaii. I know that many peope have asked this same question, however, I just went to USCIS today and the immigration officer told me that travel is only allowed to the 48 contiguous states. Has anyone gone to Alaska, PR, or Hawaii recently? I mentioned that it is a US state however he said it is traveling in international waters (!) therefore it is considered traveling out of the US. Everyone is saying so many different things. I have asked immigration lawyers and they all say it is fine. Help anyone?

It use to be allowed to travel to those places with just your drivers license, but not anymore you have to show your green card or US passport. I wouldn't even try to go there until I know for sure I have my green card. Those lawyers aren't correct.

flying to Hawaii and Alaska are fine. as long as your flight to Alaska does not connect in Canada.

seeing how Hawaii and Alaska are States, flying with your DL will be good enough. flying to PR, seeing how it's a US territory and not a US state could be a bit tricky. i have heard of a few people going to PR with just their DLs and not having a problem flying back and forth.

international waters only applies when taking a cruise and not when flying. who ever told you that, USCIS officer or lawyer, is an idiot and needs to educate themselves.

You can travel to any of the 50 states with your DL. Check the link below. That person went to PR with no issues

Hey guys,

I know that Hawaii is a state and I do agree that he is an idiot...however, since it was coming from an immigration officer, I just am scared. I feel as if they can interpret it as to how they want it to be.

Hawaii is actually a lot safer to travel to than Alaska, when undocumented.

In spite of the huge distance between the continental US and HI, which is actually greater than the distance between LA an NYC, practically all flights to the islands are non-stop. There is no way for you to enter and land in any other country, but the United States.

A flight to Alaska will in most instances enter Canadian airspace, and if it picks up foreign passengers then it will have to go through customs. Same goes for any unscheduled landings.

Regardless, most of the time you will be fine with your state ID, but it is better to be safe than sorry as we won't likely be given a second chance if we find ourselves outside of US border.

Let's say I get detained when coming back from Hawaii; will they deport me? Or will they just question me because I do have the deferred action which prevents a person from deportation.

Yes, I have looked at TSA too. I am just getting so nervous because a few people have said we are not allowed to go. I am just so conflicted!

it's a domestric flight which means you do not go through customs when you reach hawaii and when you go back home. call the airline itself so you could feel better about it
