Hey, ya I always do, it was stuck in initial review since my biometrics on 09-26-2012, the 1st time I saw that status change was last night when I checked again and saw that it went to Decision

Hey good day Todo, this is my timeline of my application process

Filling Date: 08-20-2012
App Received: 08-24-2012
Biometric Appt: 9-26-2012
RFE Sent: 02-10-2013
RFE Received at Vermont Office: 02-19-2013
Recieved letter on 04-24-2013 saying my app is beyond the expected six month processing period, and that I would just have to wait for future updates regarding my case when they get to my case. So I guess its just a matter of waiting.

Hi again all, Thank you all very much for your understanding and trying to help me understand what happened with my case. I am at the point where it's just too much. I did everything by the books, sent everything out to them that they asked for, and I got nothing from it.

Just to give you guys a better understanding of my matter, here are some important information that could better help you guys understand and decipher for yourself the kind of strange things I am dealing with when it comes to USCIS, not sure what their agenda is when it comes to DACA.

I sent my RFE with everything they asked for. Response was due by April 11, 2013, from the above date I sent mines out with everything on the 10th of FEB, 2013 and they received it on the 19th of FEB, 2013.

REQUESTED EVIDENCE THAT I SENT AND MORE:

Passport- COPIES OF EXTENSION SINCE 2005-2011 & A copy of my new Passport from 2012-2017 as well as my Passport Number. Copy of I-94, Copy of Passport Page showing my Entry into the US & NYC.

High School Records, High School Diploma, Official Transcripts from College & High School, Test Results, Internship Certificates & Completion Awards, Extracurricular High School Activities with dates, Class Schedules from 2001-2005, Copies of my Awards(15+) from my Award Banquet, even the invitation that was given to me to attend the banquet.

Immunization Records from 2001-2004, dates where I took all my shots at 2 different facilities & 2 different doctors. Copies of Birth Certificates OLD & NEW.

Proof of my paid Internships at JPMorganChase, BearStearns, USBS, MOMA Museum, Children's Museum Of Manhattan, The Brooklyn Museum. Teachers Shadowship Program, Mouse Squad Computer Building Committee.

I worked from 2001-2005 at a Supermarket in NYC called C-Town Supermarket. The supermarket was closed along with its other 3 branches. Something horrible in my life occurred giving me the opportunity to further my education and not have to work. My Dad died and left me with an inheritance, enough to live and go to school. I was hoping to atleast get my approval and not have keep taking from my inheritance.


As for the letter, I will summarize the contents and let you guys make your own conclusion:

Notice Of Denial of Consideration of Deferred Action For Childhood Arrivals, Form I-821D

USCIS has evaluated your Form and for the reasons below, USCIS has, in its unreviewable discretion, determined that it will not defer action in my name. You may not file an appeal or motion to reopen/reconsider this decision.

List of why my DACA & EAD was not approved as the letter details:

I have not established that I came to the US under the age of sixteen(16).
I have not established that I was under the age of 31 as of June 2012
I have not established that I continually reside in the United States since June 15th, 2007
During my period of residence I left the US and returned
I have not established that I was present in the US on June 15, 2007
I have not shown that I attended any Education Facilities or obtained any Certificate of Completion from a US High School.
I have not paid the fee for my Application Filing. ( I still have the copy of the money order, the receipt and a Transaction Summary and a notice from USCIS showing that they have received my money order for the fee of $465.)
I did not attend my biometrics appointment. (I have the receipt notice from USCIS which was stamped by the person/facility where I took my biometrics.)
I did not respond to a RFE or notice of Intent to Deny within the time presrcibed. ( I sent my RFE on the 10th of FEB, 2013, the Due date USCIS prescribed was April 11th, 2013.)
I have abandoned the form I-821D, Consideration of DACA because I departed the US while the form was Pending.

Last, USCIS lacks the authority to consider my request because I was in Immigration detention at the time I filed my form and remained in detention as of the date of this notice.(I never had any Run-ins with the LAW or never spent any night,day,week,month,year in any apprehensive facility, Jail, or Immigration detention as they stated.)

That's about it guys, I know its alot, but I just wanted to let you guys know what happened and to see what your opinions would be regarding the outcome of my case. Sad to see that I got denied. I can't figure out why they would say I didn't provide the information to help them make an approval.

Ok you must be leaving something out and I hope you are not trolling us because you were denied on the category of every single thing required for DACA. Get a lawyer though they will fix it as long as your story is true I would not worry.

TO CRISPFUTURE I never said I got the DENIAL LETTER ONLINE, you didnt read my previous post on the previous page saying how I got the response. I said I got a letter last night and it stated such reasons as I detailed in my 2nd post since the letter I got last night, but thanks for your concern. As for Trolling, I know we're strangers, but I don't mess with all aspects that depict my future and my well-being. But again thanks for your comment. As for the rest of my story, only I and I alone knows whats going on in my life, but again thanks for your comment, it proves so much. Thanks

From previous experiences, I learned to always use a good lawyer for all immigration things. They make sure to clarify things that may create confusion. So I would strongly advise that you go talk to one in order to submit another application. I know you cannot appeal to their decision on DACA applications, but there is nothing prohibiting the submission of another application after denial of a previous one.

When they recieved your rfe, you case didn't update? What did they rfe you for?
It sounds like they didn't even checked your case, or probably even lost it, and went straight to denial.

When they received my RFE, I was instructed that I had to wait 60 days, I checked my case online probably everyday, if not, I missed about 3 or 4 days. But since they received my RFE on Feb 19th, 2013 to now, the only update to my case online was last night, when I checked it and it went from Initial Review to Decision, which was the letter I received last night in the mail, saying that I was denied. Last time it was in Initial Review was on Monday 13th, 2013, when I checked online.
