so someone asked in another forum , this is the situation you applied for daca , you have been waiting for months and you are working with a fake ssn or someone elses while u wait , lets say a raid was to happen and sheriffs take you into custody , would you still be prosecuted or would daca protect you ?

i believe you can still be prosecuted , since daca is not a law , your thoughts ?

I'd say DACA would protect you but you would still be charged with identity theft.

Even if DACA was a law, it doesn't mean people are allowed to break other laws. Yes you can still get charged with identity theft or anything else relating to using false government documents.

This basically.

Even if DACA is not law, it protects the person from being put in removal proceedings , and deported. But the Goverment could still prosecute them for other reasons, such as identity theft, using fake ssn for work, etc.

However, that depends on how the raid was conducted. If they are only trying to put the person in removal proceedings for being here without status, then it's possible the person can use DACA and be okay.

For the government to actually prosecute the person of identity theft, they'll need proof that they presented fake documents/snn/etc. I think DACA protects us from having worked without authorization, so if that's the only charge then DACA might help the person. But it's all case-by-case.
