I emailed UCF and they are willing to give Deffered Action Students instate tuition but if you are under 24 you're classified as "dependent" therefore your parents have to have a legal immigration status as well...

Dang :/ lol im barely 21 an want to transfer within the next year. Hopefully during that time they loosen up

If you are under 24, you can claim yourself as an "independent" if you have a job and file your own taxes. I believe you have to make over $9,000 a year at least.

Hi! FIU does give instate tuition to DACA students. You just have to submit a waiver.

Sorry to ask this again, but I tried calling MDC AGAIN! to get a straight answer and well I didn't get one. So if I am understanding correctly, if you are independent you can ask for instate?

Has anyone been told by the registrars office which categories are eligible?

I work 10 hour days at a pretty good salary but I live with my mom who is sick so I am financially responsible for the both of us. I can't afford the tuition at FIU, I would have to start at MDC hopefully part time to at least finally get started. I've been waiting 11 years for this. . . I don't want to start getting loans just yet, I will be going to med school eventually so I want to stay off of student loans for as long as possible.

Hello! I found this article online today. It talks about MDC and says they have not been able to allow for instate tuition yet.

"Miami-Dade College, the nation's largest community college, has also pushed for in-state tuition for these students, but hasn't been able to offer it yet, spokesman Juan Mendieta said. He said the governing structure for the State University System allows more flexibility and autonomy to individual institutions than the state college system, which also includes Broward College and Palm Beach State College.

"We are exploring all our options, and we're certainly sympathetic and supportive of these students," Mendieta said."


I'm not sure if anything has changed since then (article was written in June) but just an FYI.

I was told there is some decision about DACA @ MDC tomorrow 8/23/2013, whether they will allow C33 for in state. I am hoping that it's true and that they will allows us to attend school there.

I was going to make a new thread, but seeing as this one is current I'll post here.

Florida: You do qualify for in-state tuition.

I've just come from the Valencia Community College East Campus in Orlando, FL.
As I was getting to the end of the hour and half long line, a woman from the Answer Center was approaching students to expedite their transaction.

As she got to me, I told her I was here to show proof of Florida Residency and request In-State Tuition.

She asked to see my documents which included: My previous and current lease where my name appears, all rent payments for the last 12 months and a notarized letter from my employer.

As for my immigration status, I checked the box where it says I'm a Permanent Resident or other status recognized by USCIS.

When she asked to see my Green Card I told her I did not have one, as I was a Deferred Action case. She took my Work Permit and read: "C33."
"I'm sorry but you do not qualify, we won't be able to give you residency."

To which I said, well I've been on the line for so long, I will speak to an advisor.

The advisor attending me took all my documents and residency application, looked over everything and went to make copies of my Notice of Action from USCIS approving me deferred action (I-821D) and my work permit.

When he finished, I told him what the lady on the line had just told me. He said he wasn't sure so asked me to wait while he went and asked somebody.

He came back and handed me back all my papers and residency application and said: "Yes, I'm sorry, you do not qualify for residency."

To which I said:

I have with me a copy of the Guidelines for Florida Residency for Tuition Purposes which I downloaded from a Government website where it states that individuals granted Deferred Action status do qualify for in-state tuition. I also have with me a court order from a United States District Judge in Miami (Wendy Ruiz, et al,. vs. Gerard Robinson, et al.) (Read About the Case) where it was instructed that the Florida College and State University System granted in-state tuition to Childhood Arrivals."

To which he said:
"I wouldn't know anything about that, you'd have to talk to somebody in the Admissions Office for this."

Very well, where can I do that?

"Oh if you have a seat right over there I'll get somebody for you."

I was instantly asked to walk in one of the offices and speak to a lady. Whom I presume was the same lady who he had just consulted.

I explained to her briefly what had just taken place. This time including that I was sure I wasn't the first deferred action (DACA) student to walk into this office seeking clarification. And went on to mention the court order, etc.

She took a look again at my Notice of Action and said: "Yes, you are right. You do qualify."

She checked my paperwork and some notes scribbled on a notepad as well as USCIS website for my case number and affirmed that she herself would process my paperwork and I should be able to see the change within the hour. She only added: "Good thing you did your research!" And also mentioned she remembered there had been a staff meeting where this was addressed and even the court order was mentioned.

Within the hour, I am a Florida Resident and no longer have to pay $1,100.00 per class, but instead only $295.00.

Now I can register for classes.

That would only apply to US born individuals who could not pay instate tuition before because their parents are undocumented (under 24, still dependant)... they can now all throughout Florida.

On Guidelines for Florida Residency for Tuition Purpose I found this....

Non-U.S. citizens who fall within the following categories are also eligible to establish Florida
residency for tuition purposes:
1) Citizens of Micronesia.
2) Citizens of the Marshall Islands.
3) Beneficiaries of the Family Unity Program.
4) Individuals granted Temporary Protected Status (TPS).
5) Individuals granted Withholding of Removal status.
6) Individuals granted Suspension of Deportation status or Cancellation of Removal.
7) Individuals granted a Stay of Deportation or Stay of Removal.
Individuals granted Deferred Action Status.
9) Individuals granted Deferred Enforced Departure status.
10) Applicants for Adjustment of Status.
11) Individuals granted asylum.
12) Individuals granted refugee status.
13) Individuals granted parolee status.
14) Individuals defined as Cuban or Haitian entrants under the Refugee Education Assistance
Act

Where can I find the following? "where it was instructed that the Florida College and State University System granted in-state tuition to Childhood Arrivals."

As far as I know that order applies to U.S. Citizens.
