What USCIS said those types of cases would be considered on a case by case basis. Did he just visit o r did he come for a certain period of time and then left?

New - Q1: I first came to the United States before I turned 16 years old and have been continuously residing in the United States since at least June 15, 2007. Before I turned 16 years old, however, I left the United States for some period of time before returning and beginning my current period of continuous residence. May I be considered for deferred action under this process?
A1: Yes, but only if you established residence in the United States during the period before you turned 16 years old, as evidenced, for example, by records showing you attended school or worked in the United States during that time, or that you lived in the United States for multiple years during that time. In addition to establishing that you initially resided in the United States before you turned 16 years old, you must also have maintained continuous residence in the United States from June 15, 2007, until the present time to be considered for deferred action under this process.

I came for visits a few times before my 16th birthday, but the time I came and stayed was 10 months after my 16th birthday.

My lawyer advised me to apply and expected me to get through. This was before they added the FAQ saying you needed to establish residence before 16th birthday.

The first RFE they sent requested some more evidence of years after 2007 and also that I was here before 16. I sent them some more evidence and a passport stamp when I came at 14.

I recently got a 2nd RFE requesting evidence of establishing residence in the United States prior to 16. They're asking for school records, employment records or documents evidencing I was present prior to 16.

I haven't spoken to my lawyer yet so I don't know if I can send anything further. But chances don't look good.

Wow, your case is gonna be complicated for the officer who's working on it. Because you sent evidence of you being in the U.S at age 14...

How long were you outside the U.S? When did you start school here?

I applied and was accepted after a two month wait. I'm 16 and have been in the US since I was only ~ 10 months old.

The most substantial evidence I had in my case were my current high school transcripts, and medical records.
