I dont understand, does this mean we can adjust status if we have deferred action and we come back from advanced parole?

In the past CBP had the discretion to not allow you back in (with advance parole)if you technically had incurred a 3-year or 10-year ban after having been unlawfully present in the US after 180 days.

Most of us who got DACA after turning 18 have this bar on us if we leave. We cannot return, even legally, untill after our ban is up.

This removes worry that we won't be allowed back in, even if we have advance parole. Instead of leaving it to the discretion of CBP, DHS is specifying that when leaving WITH advance parole doesnt count as an official departure. Think of it like traveling with America in your pocket (your travel Authorizarion documents)

This coupled with the new 3-year daca gives us a lot of flexibility when it come to studying abroad, going on business trips, and visiting ailing family members.

This is good news.

It should also be noted that if you are EWI, leave and comeback with advance parole, it removes your EWI status.

I realized I didn't anser your question specifically. But yes if you nee to leave to adjust status the advance parole keeps you from being bared from return. Also , I apologize for grammar. On my phone.

Not if you came with a visa. It won't make a difference at all. But if your an EWI, then you will be able to adjust based on existing laws. Such as marriage

Thank you very much guys. I am an ewi right now so this is very helpful for me even though it still requires a marriage lol. Anoter thing, do we still need to have some very important rewson to request advanced parole? Like our grandparents being sick and so on

Wow. Yes a lot of folk who use AP were EWI and it was on up CP to decide. If they wanted they could deny people entry. This pretty much lets people travel with out that worry

as of today yes. If this changes, it will be announced on January with all the new rules. Hopefully they remove the restrictions of educational, employment and humanitarian and allow us to travel to visit our family members we haven't seen in decades
