Again this helps in no way to people who have petitions pending from parents or siblings because they cannot prove extreme hardship for your waiver
So what was the point of this?

Exactly. There no point of it. It really will only help spouses of LPRs because previously it only covered spouses of USC.

It looks like they are going to make the definition of extreme hsrdship more concrete and expansive, so that I hope will help.

I'm talking about those that are over 21, and not covered by 245i obviously.

I know that the 2013 waiver was just a pre-emtive type of thing, where you are able to get a confirmation/guarantee of return to the US, but still require you to travel to home country for the visa interview.

If they somehow expanded this over the sons/daughters (meaning over 21), from the previous 'children' definition, I guess I'll go grab my PR visa next year (priority date was march of this year).

Waiting to see what the new guidelines say, but sounds like/ hope they're addressing one of the biggest cock blocks in legal immigration history with this.
I'm so glad you posted this, seriously. So my question is, if I apply now with my mother petitioning me and Im over 21 years old. How long can I expect to wait ? Will I be considered an immediate relative and not wait a lot like over a year for a GC ?

txgirl does have a point - but it seems self contradictory to make 21 and over and hardship go hand in hand without a good reason. I'm sure they're aware of these cases, so while I don't see this as a certain way out, I think it's definitely worth while to see what type of guidelines they come up in the next few months.

As of right now, there's barely two paragraphs describing it. Who knows, maybe DACA recipients can be part of the hardship definition ;p

No this will not get you to move faster in the line and this will not take away the fact that you still have to meet all the requirements for the I-601A waiver. Which I've mention before requires that your mother proves that it'll cause her an extreme hardship if you're not allow to consular back to the country. Which in very rare cases a parent is able to prove this.
