AB60 And Fake SSNs

I realize this isn't pertinent to DREAMers per se, but I'm hoping that enough of us have parents in a similar situation that I might be able to gather some information.

My father had licenses in California from the mid 90s through till 2001. He has not had a valid driver's license since at least 2007 and most likely at least another 5 years before that. He was relieved when AB60 passed but is now concerned about applying because, like many, he did use a fake or potentially stolen SSN for the purposes of getting a driver's license in the past.

1. He cannot recall (or claims) whether these numbers are fake or stolen, or even how he got them as it's been over 20 years since he did.
2. He cannot recall whether he only APPLIED with these numbers and was denied, or whether he was actually granted a license which was then terminated. He DID receive a notification from the DMV asking for a corrected number, which leads me to believe he was ISSUED a license with that number.
3. He was stopped for a broken tail light a few years ago and his most recent license (which was expired at the time) was taken from him but he only had to pay a ticket and never had to show up in court.

That aside, he has no criminal history and has been paying his taxes dutifully under an ITIN. Naturally, he's concerned that he may be endangering himself if/when he applies for a license under AB60. We've read that for DAPA they will be looking the other way if people used fake SSNs in the past, but will that be the same for AB60?

I've seen two different versions of the driver's license applications.One stating something along the lines of "have you applied for a license under another name or number in the last 10 years?" and others asking if one has "ever" applied. Gonna pick one up as soon as AB60 is implemented just to see but...advice on his best option? He's contemplating a lawyer but frankly he doesn't seem keen on going to pay someone to tell him "what he already knows." (that he shouldn't go for the license.)

The updated application has been around for a few months, make sure you get the application that has a Revision year of 2014, as for getting a lawyer, they will not do anything unless DMV starts a criminal case against the person but I highly doubt it

You can also find information on Know Your Rights and what are the scenarios to apply by going to http://driveca.org/toolkit/

But, overall, it seems like there will be discretion used when evaluating DL applications. It is a big concern for the community, but as long as your dad used the DL for driving purposes only, it might be fine. Best thing is to wait some time (6 months or so) before applying, to get a better understanding on how the DMV will deal with this.

So will they be denying DLs to people that supplied a fake SSN on their previous expired drivers licenses?

I think your advice to wait a few months is sound. The problem is that my father tends to have a pretty cavalier attitude. He doesn't know if the number is someone else's or made up, he doesn't know if he has an order of deportation, he doesn't know whether a (scam) notary that claimed they were arranging to get him legalized and a license legitimately mailed things in to immigration. The DL wasn't just used for driving, but for things like rental applications, medical records and opening bank accounts. No unpaid debts or anything, but the number was used repeatedly. Looks like i'll be cancelling his appointment with the DMV.
