Need some advice please

Hello Fellow Dreamers,

Thanks to all your help my application was recently approved. I have a dilemma currently, and Im trying to decide what is the best way to approach it.

My sister is a US Citizen and my mother is a US Permanent Resident( who will be eligible to become a citizen in a year or two I believe) My problem is im trying to decide what is the fastest route to becoming a permanent resident, should I have my sister apply for me, or my mother now as a permanent resident, or wait until my mother becomes a US Citizen?

Ive looked at the USCIS website, but its a bit confusing, Ill admit I can probably do a little bit more research(and I will) but just wanted some input and see if anyone here could give me any advice on this dilemma, Ive already put sending my application off, so I want to do it ASAP to get the ball rolling.

I was in the same situation as you, sibling filed for my mother who then filed for me while she was a Permanent Resident. When my mother became a US Citizen my Priority Date became current but since I had overstayed my visa past the age of 18 and was not covered under 245i I could not adjust status in the US since overstay is only forgiven for immediate relatives of US Citizens. Long story short it depends on your age, how you entered the US: if you entered with a visa, did you overstay past the age of 18 without DACA protection and for how long? Do you have a previous petition filed for you that may grant you protection under 245i?

I was brought to the US at the age of 4, we crossed the border illegally from mexico. I am 31 years old and unmarried

Your only option is clearing your entry with AP and marrying a legal alien. That is it

There are other options such as joining MAVNI as a medical professional.

Generally yes. F1, F2B, and F4 categories do not allow you to adjust status after living in US illegally.

F1 - Unmarried sons and daughters of USCs.
F2B- Unmarried sons and daughters of LPRs.
F4- Siblings of USCs.

Have your parents had any kind of a petition for them before April 30th 2001?

My mother became a resident through my sister once my sister became a citizen, my mother was once married to a us resident and we were in the process of getting our papers, I think this paper work was filed in late 90's, but by the time out appointment was up, my mother and step father had separate and never went. I was very young and didn't even know about my legal status at the time.
