Visa u question

I’m 20, the incident happened this year after I turned 19, my lawyer says I can’t claim my parents because it didn’t happen when I was a minor.
I think she is wrong, but she’s a lawyer and I’m not. I know many of us aren’t either but does anybody know whether you can file for them before turning 21 regardless of when the incident happened?

Do you get deferred action while waiting on the visa?

Takes years even to get deferred action. I submitted my uvisa application in Nov 2014. I am still waiting.

Parents can be included as long as you file while you're under 21. That means have the I-918 and Supplement B as well as I-918 Supplement A for both parents, and I-765 for each for you at USCIS before then, doesn't matter how long it takes them process it.

Basically the packet would be:

Form I-918 for your U-1 visa status
Form I-918 Supp B - Certification from law enforcement
Form I-765 (category (A)(19)) - For your work authorization
Form I-918 Supp A for father
Form I-765 (category (A)(20)) - For their work authorization
Form I-918 Supp A for mother
Form I-765 (category (A)(20)) - For their work authorization
Any other relevant documentation that's required.

No... havent gotten any new update since biometrics. That was in December 2014.

Gotcha. I sent mine in on August 2014, got my waitlist letter in March. I'm really hoping I get the actual visa this year, but can't find any resources online on how many people are currently on the waitlist (not just pending, but have gotten the waitlist letter).
