They returned my packet and missed deadline

Hey guys, quick question. I sent my brothers renewal packet and it had an error (didn't check that he is not a terrorist) and shipped it out. They received it on time (before the deadline) but then they returned the packet due to the error. They also attached a green page that says it's ok to return it once I fixed the error. So I sent it the next morning with next day delivery. Which was after the deadline, but I assumed it was fine because the page they attached said to just place it in the front of the packet. Now after they received the packet, which has original date received on September 29 (the first time we sent it) they decided to decline it due to the fact that the second time we sent it was after the deadline. Will a lawyer be able to help? Thanks.

Call USCIS first and see if they can address it for you. Lawyer's professional advice can never hurt either.

Definitely call USCIS first, most of their employees aren't the sharpest tool in the shed.

That's messed up. You should definately call USCIS and ask that the application be accepted like the green paper states.

Did you make a copy of the green sheet? This would be helpful for proof that you were allowed to re-submit.

Unfortunately we didn't make a copy. We thought it would be o.k. And now that they returned the packet they removed that page.

Sad to hear about your situation, OP! See if your Congressional Rep or an attorney can intervene and help.

Everyone else - please please make multiple copies of every single document you send/receive from USCIS. Our lives depend on it. Even when I used an attorney - I made them give me copies of everything and anything we sent in. Just as a back up. I realize it may sound extreme but there are no (or few) second chances here unfortunately.
