Is OP male? Does your SO work or are you the primary breadwinner ?If you have a small child then I think it would be easier to prove hardship to both your SO and child. Not sure what country you are from because that would also make a difference.

If OP is female then it is easier to prove hardship to a USC since the baby needs the mother especially if she is breastfeeding. My cousin was caught crossing the border when she was already an adult. She had to go back to Mexico when she was AOS but was there for like two weeks because her son was young and she was a stay at home mom.

If you have been in the relationship for a while and have a child already then why not go for it. You can just do a court house wedding and a dinner at a nice restaurant.

I'm from the Dominican Republic. My fiancé is a USC born here, Nigerian background. He works and is the primary and right now im full time mom breastfeeding exclusively baby is 3 mos old.

Thank you! We are going to just get this marriage and paper work done. If DA passes before March then that'll be cool but march I would be sending paperwork. I was just afraid to leave the country. But I can't look back just have to be hopeful the waiver will get approved. We both have extremely clean records too. Nothing on it.
