So I keep hearing all these lawyers on social media and Tv telling us that since DACA has reopened again the advance parole would clean our ewi status and would help us adjust without having to get approved for a waiver if petitioned by a US citizen. Is this true or does advance parole not give us that legal entry anymore to be able to adjust?

not trying to be insensitive, but what have yall been doing not using AP even once for the last 8 years? it's kinda too late to use that route now..

Is it because of any modifications from the Trump administration? Or will this stay in place even after Biden takes office?

I think Biden would either reverse course or a more friendly BIA would rule that text of 245(a) is pretty god damn straightforward.

While it hasn’t been made official to include DACA I would say it’s a given it’ll happen since TPS isn’t that much different than DACA. USCIS recently issued this memo for TPS holders re:AP and ‘curing’ their unlawful entry.

(3) TPS-authorized travel will not satisfy the requirements of “inspected and admitted or paroled” into the United States for purposes of adjustment of status under section 245(a) of the Immigration and Nationality Act.

So right now, it's only for people on TPS until they make it official for DACA too?

if you used AP prior to 2017 and go through AOS now, did it clear your EWI or will you have to go back your country of origin? Somehow I missed this, can someone explain?
