hi folks, are we considered eligible to apply for jobs with this disclaimer below?

"This position must meet Export Control Compliance requirements, therefore a “US person” as defined by 22 C.F.R. § 120.15 is required. “US Person” includes US Citizen, lawful permanent resident, refugee, or asylee"

Thanks

looking it up on Cornell Law site, i saw the "protected individual" part (snippet below) and was hoping we fell under it. Was a great tech job that i was qualified for.

U.S. person means a person (as defined in § 120.14 of this part) who is a lawful permanent resident as defined by 8 U.S.C. 1101(a)(20) or who is a protected individual as defined by 8 U.S.C. 1324b(a)(3).

We do not have a status. Its just deferred action. Having status gives u the ability to adjust into eventually becoming a citizen. We do not have that ability. We are basically here illegally with just an EAD.

We don't. 8 USC 1324b(a)(3) basically says: USC, LPR, Temporary Lawful Resident (basically those who got status under the 1986 amnesty), Asylee, and Refugee.

Register an LLC or other business entity instead if you wish to import shit. The definition of US Person in 120.15 includes those:

U.S. person means a person (as defined in § 120.14 of this part) who is a lawful permanent resident as defined by 8 U.S.C. 1101(a)(20) or who is a protected individual as defined by 8 U.S.C. 1324b(a)(3). It also means any corporation, business association, partnership, society, trust, or any other entity, organization or group that is incorporated to do business in the United States. It also includes any governmental (federal, state or local) entity. It does not include any foreign person as defined in § 120.16 of this part.

Anyways, if this is Amazon or some other FAANG company, they won't care. Been there, interviewed, didn't get it, but being a DACAer didn't get me shitlisted.
