Right.

Except that if the person who came here illegally has 245(i), then they don't have to go back either. If you came here legally, you can fix status in country so long as you're approvable and don't get deported.

A. well, uh, who are you getting married to? You say "our" native countries, which implies to me that you're looking to marry someone else who is undocumented. If that's the case, you aren't going to get a green card that way. You only have a possibility of getting a green card if you marry a US citizen or legal permanent resident.

B. How did you come to the US? With visa (real or not) or without? Are you under 245(i)?

I came here when I was 12 years old without a Visa, and I don't fall under 245i. I am about to marry an U.S citizen

I-601 waiver not worth mentioning? Not true!
As far as Mexico goes, the only people who get denied in CDJ are those who hired crappy lawyers or went down there having no clue what a HSL or what a waiver was.. anyone who knows what they are doing can get approved.. the biggest obstacle is time.. On our forum we have around a 90% approval rate for Mexico.. and those who are denied can request a new appointment in a few months. It is a crappy option yes, for other reasons like money, time, having to leave the country, stress, etc. but it is possible to get approved, and it's the ONLY option for most of us. I am not sure about the other countries but by no means is it something that is "not worth mentioning" .. Thousands of people need this option and don't know it exists and that's really sad ..

To anyone who needs a good lawyer for the waiver I must reccomend Laurel Scott. www.visacentral.net .. She has a 100% approval in CDJ and I am not sure about other countries but I am sure extremely high.

I never understood why the approval rate varies so much per country.

Shouldn't it depend on filing it correctly and showing hardship properly; not that anything to do with immigration has ever been fair.

Ok that's weird because my uncle entered illegally but he didn't have to return to Mexico to gain his legal status. Is there another loophole?

@DREAMAct01 there's no such thing as a loophole. He probably falls under the 245i.

@Task hayire falls under the 245i so he doesn't need a I-601 waiver.
