Did anyone petition for you on or before 4/30/01? If not, you have to file for I-601A and prove extreme hardship.

nobody petitioned for me before 01. Mom has had a green car since 2007 i think. I was 21 by then.

Your mom could have filed for you in 2007 and you would have had a GC few years back if your I-601A was approved as well. Most likely you would be close to becoming a U.S Citizen as of today. Well, we can't go back now but she can definitely file for you now in the F1 category.

My uncle is a USC but he's retired that's why I'm concerned about having a financial sponsor and if it's needed. I make 50K and it shouldn't matter. I'll just have to cross that bridge when I reach it.

^^Trinidad. When she files I'll be in the F1 category. I still have to wait a few more years for a Visa to become available since I believe they're now in year 2011/12. At least there's finally some forward movement. *sigh*

My USC mother filed I-130 for me in June of 2011

Visa became available in October 2017.

I have my EAD and now are at the last stage which is waiting for the interview letter. I used 245i for it so I don’t need to file for I-601A and depart USA for Consulate interview.

^^ 6 years. not bad some had to wait over 20 years and still waiting. How soon after did you get your EAD when the visa became available? I entered with inspection so I don't have to leave to adjust so it's just a matter of filing I130 and then I485 (unless I'm mistaken). My cousin overstayed her visa, she got sponsored and when she tried adjusting her lawyer told her she had to leave to adjust. It didn't make any sense to me. Of course she didn't want to. She was afraid shewouldn't be able to come back.

Can I file 485 concurrently with 130 or do I have to wait for the visa to become available and then file 485?
