I finally sent my AP application today. I did it for humanitarian reasons (my mother is sick). I did the whole filling out of the paperwork by myself but I did speak to a lawyer before starting the process.

I needed to know if leaving the country with AP was safe and what the risks would be if I did. She told me that a couple of her clients have gone to their countries and came back with no issues at all (what a relieve!), she also told me that as long as I don't commit any crimes that there should be no problem in getting back into the country. Lastly, she also told me that by entering the US with AP it would clear my EWI (entry without inspection) which in a future if I get married to a US citizen then it would be easier to become a legal resident and hopefully one day a US citizen.

The documents I sent in the packet were:
- Form i-131
- Doctor’s letter and the translation
- My birth certificate and the translation
- Copies of my DACA approval letter
- Copy of my EAD, driver’s license and passport
- Two passport pictures
- Letter I wrote stating why I needed to go
- $360 money order
- Form G-1145 (not necessary but it helps to get updates on email/text)

I’m praying everything turns out okay and that all the information I sent is enough.
Hopefully I'll be able to go in November.

congrats!

I am applying soon as well just waiting for a few documents. I want to do it myself without a lawyer but I am so scared to mess it up. I did my DACA on my own and it worked out fine but this seems much scarier.

I apologize if these questions sound stupid but I just want to be sure.

For question 6, Class of admission what should I answer? Is it the type of passport/visa I have?

I am from Brazil and I only have my passport no visa anymore. I plan to travel to Europe and Brazilians don't need a Visa to travel through Europe.

Also for part 2: Application Type

I believe the correct answer should be 1d. "I am applying for AP to allow me to return to the US after temporary foreign travel.

For part 3: Date of intended departure.
My trip will be between 3-5 days. I don't have the exact answer because it will depend on my job. Also the travel date might differ a few days. Does that have to be 100% accurate?

I will be leaving most likely on 1/18/2016, 1/19/2016 or 1/20/2016 but I don't have the exact one.

And then for question part 5: Since you became a permanent resident of the US, have you filed a federal income tax return as a non resident or failed to file federal income ta return because you considered yourself to be a nonresident.

I'm not sure what to answer here. I've been here for 16 years, got my DACA in 2012 but ever since I started working I always paid my taxes. Now with my social and before with a tax id. What do I answer for this question?

I really appreciate the help.

Thank you!

For question 6: I know some of us put DACA and it was fine

Part 2: Application Type
It should be 1D - "I am applying for AP to allow me to return to the US after temporary foreign travel".

For part 3: Date of intended departure.
This is where it gets tricky for most of us because we don't now when USCIS will approve our case. I'd say just put the dates you are planning on going but try giving them a window, for example: if you're planning on leaving on October 10 then ask permission from October 5 to October 15. Just give give them and give yourself ample time to travel.

For question part 5: I don't think you're supposed to fill out this part. You can fill out part 7 which is if you're applying for Advance Parole which you are.

Hope this helps. Good luck!

I applied monday sep 21st for humanitarian reason. However, I forgot to add the address of the translator. Hopefully, they don't mind and everything goes through. I want to travel next month so I'm hoping for a fast process. I let you guys know how it goes.

I want to tell everybody how my case ended up. As i said before in my first post i was going back to Peru to visit my grandmother who was sick by the time i started my case (AP) but she passed away during the process of case.

Based on my advanced parole letter i should be back before july 29th.

Well i travel to Peru on june 25th with no problems at all.
I got back on july 27th. I wil try to explain all the steps i did on my way back to USA ONLY.
Once i arrived to the airport at Lima - Peru and spoke the airline clrek they asked me for my passport and as they couldnt see my visa in my passport he asked me for my green card and i told him. I dont have a green card but i have a letter (advance parole) they did not know what that was, so he called a supervisor and he started reading the letter i showed him my driver license. He told the clerk it was good. They made a copy of the letter. Afrer that, all i have to do was get on the plane !
Once i got to Miami i went to passport control. And showed them my passport my us custom form and my 2 letter of (ap) the officer did not say a word. He called another officer, gave him all my documents and asked me to follow him. I was taking to US CUSTOM AND BORDER CONTROL OFFICE it was a private area. I was not the only in that room there couple of people waiting.
Some people were called out and they were interviewed at the windows. I was sitting close the windows so it wasnt hard for me to listen to them. They asked them many questions, but they sound like they just wanted to know why they wanted to be in the country and if they were telling the truth.
I waited about 30 minutes before my name was called out. I approched to the window and the officer asked. Where i was going to, i told him i was going back to North Carolina. At this point i was ready to show all my documents and the documents from my grandmothers death. The officer handed me back my passport my US custom form and one AP Letter which was sealed then he said thank you. You can go to claim your bag and have a nice trip to north carolina. I was not asked any other question other than where i was going to.
I do not know if this is normal but this is what i went tru. I left the office i had a question on my mind. Since i'm waiting for my green card because my mother is citizen i know it might take sometime. If i need to travel again do i have to wait some time i order to re aplly for another AP? I asked that question to another officer and he said i was paroled for a year but if i need to travel outwide the US i need to re apply for AP. Can somebody explain me what being paroled for a year means? I still dont understand. Thank you!
You mention your mother is a citizen, mine is too. How are you adjusting through her? I am 25 and was told I can not adjust unless i leave the country and wait 10 years. I came here on a tourist visa at 10 years old and now I have DACA. Thanks!

I got my receipt number on friday. My app was routed to Nebraska. The only problem is whenever I try checking my case status, I get a validation error .
