My theory is that you still have Work Authorization, but USCIS is not telling you.

Worth a try.

I can't verify, unless it's ran by my HR, but they are letting me work through this process. Would be worth a shot for those who went on leave or are using PTO.
I'll keep you guys posted on what I hear back. My employer just requested HR to run E-verify on me to see if I'm still eligible for employment. I really hope this work or else I'm fucked.

Just got an email from the ombudsman saying something different than what other people posted.
I think it's just more of their usual BS, but perhaps "being actively reviewed" sounds encouraging:

"The CIS Ombudsman's Office received an update from USCIS informing your case is still being actively reviewed. USCIS is not sure how long the review will take but will continue to provide the Ombudsman’s Office with updates.

As the updates are received, you will be notified. We hope that you find this information to be helpful and thank you for your continued patience."

We just contacted the Ombudsman and our Congressman's office. I don't know if it will do any good but fingers crossed.

We have finances budgeted for 3 months and then we will be in trouble.

Told by HR to have physical ead card handed to them by this Friday, or else be put on leave without pay for up to 30 days, and if beyond that period, termination...I expire 9/4.

I got that response today, too!! I think Nebraska just said that to get out of it without admitting that they are delayed. I called the ombudsman after I got that response to see what else can be done since I've been waiting for almost 7 months and they said that they can only request updates.

I know!! I thought they had some kind of higher power but I guess not. I asked how often they request updates, and the lady told me that they do it every 30 days.

Hi all,

Just for reference, I was notified by text on Saturday August 20th that my account had been updated to reflect that USCIS had finally scheduled my bio appointment after 162 days. I received the paper notice in the mail on Thursday August 25th for my appointment scheduled for Sept 8th, but was able to walk in to my ACS location and successfully complete bios yesterday August 29th (Michigan City, IN). In the meantime, I still have a couple weeks of work before the big day. Thankfully, I've been upfront with my boss from the beginning and told him about the delay a month ago when I still hadn't received my bio appointment. He is aware of the delays, and I just talked to him again on Friday and he is going to let me work from home until I get approved so that I don't have to drive with an expired license. We are a small business, so I'm luckier than most others and will still be paid. I will still be praying that I get approved in the next three weeks. Good luck everyone.
