Just an FYI, The bars surround visas and green cards.

On the false claim, one has to attack the very claim itself. There are some defense options, but they are minute.

I saw the bar to permanent residence. I thought GC to Citizenship as well since N-400 was naturalization application? Can you elaborate more on how one attack the claim and the defense options?

You are correct. A permanent resident claiming Citizenship is also subject to that bar as well as they would be removable. Only citizens can say they are citizens.

Here is an AILA memo that covered the issue.

Why are we all so concerned about this issue?
For people that have already lied: tough luck, maybe speak to a lawyer?
For people contemplating this: Why would you even spend time thinking about this?
Bottom line: DON'T lie. Don't say things that could hurt you. Plain and simple.

It intrigued me because I never would expect that a white lie would have such a severe penalty. Being curious and informed is always a good thing. Who knows if this will one day be useful for someone I know or a complete stranger I meet. That and I'm stuck in a endless loop of boredom.

Because a lot of DACA dreamers have probably done it once in their life. It might not be you but it'll definitely be others. Question is if Congress pass a bill that gives a pathway to citizenship will there be a special clause or waiver to forgive false claim?? If not, it will probably disqualify a majority of Dreamers. Another question will be when will this bill be?? 2 years?? 5 years?? 10 years??

Because this is a seemingly small lie that can absolutely destroy someone's life in the future when they try to get a green card or become a citizen so they have to be aware of this now before they do it.

And for those who have already done it, they have to realize what if any defense they have against it and be careful not to accidentally bring it up.

And just to piss you off.

Seems like you're not alone. There is tons of folks who are experiencing the same issue. They have this bill in the house. Doesn't seem like it's gotten any traction but it would help you if it passed.
